The cyclist had right of way, the car driver was completely in the wrong but the cyclist could have avoiding it happening. But he didn't look for/at the car, much the same as the car driver didn't look for/at the cyclist. Rolling Eyes

No one gives a shit about right of way around here, theres some give way points on my route to work every morning which some cunt in a can thinks that on my approach it would be best for the both of us to pull out so theres a head on collision. EVERY MORNING. They do it to HGVs and school buses and once i did see them and tried to stop, that was when the police fucked me with £400 fine and 4 points and i wrote my bike off trying to avoid them. So either way really ste, your fucked if you do or fucked if you dont. Laughing

Dodgy cop who wanted to up numbers, did me for generic due care and attention. Though the woman who pulled out on me from a left hand junction who was looking on her left the entire time she pulled out, as i tried to stop i lost the front and my bike was a gonner, wouldnt of been so bad, it bounced off their BMW giving them whiplash and they had sold the car 24hours previous, it would of missed their car if they would of pulled half way out.

I doubt it, as it's a criminal offense, therefore needs to be proved beyond all reasonable doubt (can't see it sticking based on what's been said there). On the other hand guilty until proved innocent is the order of the day for traffic offenses these days, allowing spectacular miscarriages of justice to occur.

similar thing happened to me at the beginning of March, Broken thumb, damaged ligaments in hand, black and blue all down one side.
Stupid tosser didn't see me, with my high viz jacket and super bright led lights. Could of been worse if it wasn't for my cycle helmet.
He did say it was his fault to the copper.

He's probably one of those annoying cyclists who believe they have some sort of moral right-of-way over all traffic because they're saving the kittens through no emissions.
