PostPosted: 22:40 - 14 May 2010    Post subject: Pulled for no insurance - But i have insurance. WTF Reply with quote

Hi all, just a quickie.

Got pulled by a nice pair of rozzers tonight.

Gave me some hassle for "no insurance"

Now i have two bikes, i KNOW i'm insured.

I have the flippen paperwork infront of me to PROVE i'm insured.

The copper has given me the ticket and let me ride away.

He said he will call me Sat/Mon after phoning the insurance companies to check this.

I gave him the reg of my other bike, which he confirmed as being insured (it's on the same policy, every little helps)

Now i've just got in, and noticed on the ticket his written my reg down as. "09" when my reg plate states "05"

I also got a fixed penalty for my plate being smaller than legal size.

Granted that's my fault i'm happy to pay that, i have a legal plate on my PC desk at the moment.

Where do i stand with the insurance issue, regarding him writing down the wrong reg?

Thanks

www.askmid.com

See if your bike is on the insurance database, contact your insurance company if it's not.

He gave you a ticket for the alleged offence, then let you drive away - thus committing the offence again?

Seems a bit strange.

The MIB are pretty bad at putting policies on the system in a timely fashion.

well if they checked insurance for the wrong bike and has written the wrong plate than I'm sure he's in the wrong not you, but then again police hate it when you try and correct them.

And when he rings say you will go down the station with your policy to prove it I guess.

i think theres a fair amount of precedent where small typos / coppers writing it down wrong at the roadside gets allowed in court.

You having insurance is a fact irregardless of his over the radio chitty chat - you have insurance so there's no offense.

AJB is correct - if insurance was in place at the material time then there is no offence.

Worth double-checking if you haven't already done so; having the certificate counts for nothing if your DD has bounced and the insurance company cancelled your policy...

Is there a producer section filled in on the front of the ticket - if there is, don't forget to produce your docs within 7 days or that's an offence too!

You can't really blame the copper for getting your reg wrong if your plate was undersize Wink

The rozzer said i only have to produce IF he phones me and can't find insurance.

I thought it sounded kinda weird too that they willingly let me scarper.

As for the plate being undersized it's only a tiny bit under, and the other copper managed to write it down fine.

I got a ticket for the wrong reg, 6 points 200 quid fine but
i got it ripped up.

Take your docs to the cops who charged you, if you can copy them
leave a copy, explain what happened and most of all be cool.
They dropped mine but i still got a summons and called the court
and was half expecting to have to go in front of a judge, but
the court called me 2 days before to confirm its scrubbed.

They impounded my bike and that cost me 150....put down to
a loss....i was also left to hitch 150 miles home after they took
the bike. I stuck my thumb out and the 1st bike-Ducati 750
stopped and took me 25 miles out his way than by pure
luck a friend was in the carpark of the petrol station at Tyndrum
and gave me a lift all the way home.

THEN i paid another friends petrol to take me to get the bike
back from impound....

an expensive lesson all because of 1 letter.

You can if he stopped and walked up to the bike. If he could see well enough to be able to drive on the road he should be able to read any size numberplate.

On the way to Elvington some years ago we were following a ducati 916 in the van.
They have a small rectangular rear reflector between the exhaust and the cans. The rider had replaced it with a numberplate of the same size.
Though, of course still there's nothing to stop him just putting his head closer Smile.

Oh and I'd suggest it's definitely worth at least calling the police station and asking to speak to / leave a message for the officer to explain the situation.

Quick....swap the plates before his next visit...(unless he got photographic evidence)...then show him his mistake and the insurance documentation, and look puzzled and voila! He should make it null and void. Perhaps?

Well i phoned my ins company to confirm it was there. Thumbs Up

An hour after this Mr. Policeman gave me call. To let me know i was insured, and to rip the ticket up.

So job done really.

Still got my £60 fine but hey ho.

Strictly speaking the offence has already been commited. The offence is due to failing to produce the documents when demanded. Producing them within 7 days is a statutory defence.

All the best

No shit?! Wink

The tenor and wording of the original post suggested that this wasn't a thread to enter into the exact letter of the law - but rather suggest a common-sense solution!

out of interest what was your plate size ciaran?

mine is a 5x7 and when i was stopped at a routine roadside stop by a load of coppers lined up a road, they checked my documents but didnt mention my nearly bald rear tyre or small plate... i guess traffic cops are a bit pickier?

Traffic cops are pretty anal on it.

But that's their job.

Normal coppers don't have are not armed as much knowledge which usually leads to arguements at the side of the road.

Fortunately the RR is legal to the letter, minus the plate that was on it when i bought it, and the baffle-less scorpion exhaust.

It's an arse getting pulled for easy stuff.
Load cans and wee No. plates.

The plan should always be stealth.

Do not do anything to get yourself noticed.
Put your big baw heid up and it will most probably get shot off. (and no doubt any poor sod that is with you.)

Tattoos, Male Earings, Daft/Saft hair cuts Wee No. plates Loud obnoxious end-cans are among the things some folk need to be 'different' from the rank and file.
Well be as individual etc. as you wish but do not bleat when you get nipped.
It is the price ones has to pay for individuality. Smile
