Hey there guys,

I am just after some clarification from some people that may be a bit more knowledgable than I.

To replace the SV the father was thinking of picking up a K8 GSXR600 for both of us to use along with the KLX300.

One of the benefits of this is the S-DMS so we have the A, B and C driving modes.

I was wondering as I am 33bhp if we had the ECU maps programmed to:

A: Full power.
B: Rain.
C: 33bhp.

Would this be legal? Of course when I am riding it it will always be on C as the police are on my back about restrictions since my crash last October but he doesn't particularly want to ride about on a restricted bike.

Just wondering if anyone knows the legality of this? I am unsure if the law is the bike doesn't put out more than 33bhp in current configuration or is not capable of putting out more than 33bhp at all.

AFAIK you can ride a 'Busa as long as it's restricted to 33bhp. I suppose if you could prove that it's in 33bhp 'mode' if/when you get pulled you'd be fine.

The law states the bike has to have a power output of <= 25kw.

To me that means at all times. Switches are illegal, and you'd probably get in even more brown stuff if found out.

However, the Police would have to prove that when being pulled/in the case of having an accident that I wasn't using the C mode?

This is why I am wondering if it's output in current config or capable output.

It's a very intresting point. Maybe go your local chop shop and ask what they think?

If you wanted you could do it and if he gets took to court it would be up to the judge to decide and then set a precedent.

The way I see it is that if the switch for changing modes is on the bars then I don't think that would be legal. If the switch for changing modes is hidden away under the seat meaning that you can't change modes whilst riding, then that goes some way to show that you couldn't be using the full power mode so you'd be legit.

If the switch is accessible when riding then that means the bike can make more than 25kw.

See this is the issue.

No-one knows, not even the Police if this is legal.

As I presumed it was innocent until proven guilty, they'd have to prove I was on A or B as far as I know they retain the onus of proof in this situation.

However, if it's something like the bike can not put out in total any more than 33bhp, then it's illegal.

Like I said, looking for clarification on an interesting point!

Suspect as it can be changed on the fly it is no different to trying to claim that you are not opening the throttle enough to exceed 33hp.

The wording of the law is something like "must not have an output greater than..." Which means you'd be in the poo.

Is anyone able to find the actual legislation that rules this?

I have been looking at the Statute Law database for hours and can't find a trace.

The legislation is here:-

It just says "net power output".

Afraid I do not see how it would be legal to use the switch. No different to just not opening the throttle enough to go over 25kW.

you truley are a tool . youve had 2 crashes now and you want to go around ridign a full power bike while on restriction ... yeah good idead how about you go back on your 125 ....

I disagree with everyone else, as im sure ive heard of a bike before programmed for a 33bhp map, injection of course. and that was legal...

I dont think you'd have a issue if it could remember which mode it was, even when crashed and if the switch was well enough hidden that a crash assessor wouldnt play with it..?

I agree with you, even "normal" restrictions can be taken out quite quickly.

If it has fuel injection, get the restricted ECU from Suzuki, takes 10 seconds to swap them over for when your dad wants to ride, my bike was restricted this way. Thumbs Up

yes i have. I just fail to see hwo you have been so unlucky tbh. and i wouldnt fuck around id get proper paperwork etc with the luck you have had

there is no need for proper paperwork im not that thick but after the luck he has had with his bumps that little bit of paper could be rather usefull . as much as it is a pile o turd and i dont have one for my 33bhp kit. after 2 crashes in what 6 months? id like to have everything in my favour

And crashes can happen for whatever reason. There's other people who've had more in less time for stupider reasons.

I see, dont dabble with the newest machinary i must admit, surely a switch could be spliced in nearer the ecu tho.

You could probably do that, but not with a bike that has the switch at the front as well...

Hey guys,

There is the PCV, which I guess I could mount under the seat in a place where it's impossible to change 'on the fly' as in the bike has to be stopped to do so, still thinks this conflicts with the law though.

As I said, I guess I'll just have to make my Dad put up with it! Laughing.
