So yesterday i bought a new bike, went to go-compare for a new quote and bikesure came back the cheapest by a good margin

Bikesure £193.75

Swinton Bikes £469.04

Motorcycle Direct Gold £604.56

Direct Choice £621.21

Motorcycle Direct Diamond £630.34

I actually ran very similar quotes a few times and they were always coming back the cheapest. Took out the policy, paid first month deposit, printed off all the relvant paperwork including certificate and what not.

Today i get a call from Bikesure telling me they had a computer error yesterday meaning that it was throwing out basic quotes for anyone and for they now want an extra £150 quid for the same level of cover!

Havent had a look through all the docs yet but my dad reckons since i have effectively entered into a contract with them already then they cannot charge me any extra.

They offered to fully refund me, upgrade my policy or waive a slight increase in the premium if i want to reduce cover to TPFT. Also said i get either £25 or £50 worth of tokens depending on how i proceed.

Said i would call them back tomorrow lunchtime to resolve the issue one way or another.

What do you lot reckon on the matter?

as far as it goes, you've entered into the contract at the price you were given. if they sold you the policy at one price they cant legally charge you something else because they fucked up.

end of the day its a purchase and the laws are very clear cut on them. if you go to tescrap for instance and the price they have advertised isnt the same price as is on their system and you point this out, they are legally obliged to give you that product at the advertised price.

i dont see how its any different with the insurance people.

they will sit on the phone and tell you it was a computer error and your reply has to be "thats not my problem, you cant hold me accountable for an error on your part"

if they try and give you a hard time tell them that you will happily contact trading standards if they dont sort the problem out to your satisfaction or tell them to stick their insurance and go elsewhere.

I suspect that if they could change the price a lot of people would get phonecalls 2 months after taking out insurance saying the cover went up by £xxx so pay up or we cancel your insurance Razz

If you have paid and received the contract i don't think they can do anything about it.
If it was the cheapest quote by far i would stick to my guns if i was you. If you don't it will end up costing you a lot more. Don't expect them to be that cheap next year though lol

it is true. they will try and wriggle out of it and the majority of customers dont realise that they can argue the point with it and back down but according to trading standards they have to sell you the item at the advertised price even if their system is wrong.

there are a few conditions, small print if you will,

the advertisement cant have been tampered with, the date on the advertisment cant have passed. ie. offer valid until (yesterday). where it states "selected stores only" you have to make sure the promo is that store. etc

Had the same with the Supra i bought.

2 quotes came back for around £1500, the next were £6k upwards and most couldnt quote..

Advertising in a shop such as a price tag is an offer to treat, this is not an offer to buy so therefore it is not part of the contract.

If someone wanted they could double the price at the till point.

However it is an offence under the Consumer Protection Act 1987 part 3 to give consumers misleading pricing.

So if you argue you will give it you at the advertised price however they have no legal obligation to give it you at the advertised price.

Also "selected stores only" could be seen as misleading so if you argue you can get it at the cheaper price Very Happy

Agree with Ian. A price ticket in a shop is an offer.

However in the case of the insurance here I think that they have agreed to the offer. No different to Tesco turning up at your house the day after you have eaten your shopping and asking for more as they didn't charge you enough.

I'm not sure about that one ian.
If that was true then why bother putting price tags on items if that's not supposed to identify how much you will be paying for the item when you get to the till.
The price tags are not guidelines or "approximate" prices.
They are supposed to represent the price.

Can you imagine the chaos if there was no laws to keep businesses in line regarding pricing.

"Yes sir i know the price tag says £1.24 but that particular pint of milk costs £190.95. Will you be paying by cash or card?"

Of course i know it's not valid for offers that has expired and price tag hasn't been updated. But for other things i don't think there's anything shops can do if items are wrongly priced. After all it's up to them to price things right.

Thats were the consumer protection act 1987 part 3 comes in.

I was just pointing out it wasn't a god given right to have to goods at advertised price. But retailers will get there arses slapped if they keep mispricing goods.

But 9/10 retailers will do what you want just to save face Very Happy

Ask them their stance on wether they can legally change the price.

No where does the Bikesure (Adrain Flux) site show the common E&OE. Which is the usual cop out.

I would stand you ground as they have given a quote which is valid for 30 days. Unless they have something in the T/C that makes a point that they can increase the price if they make a error. I would tell them that you are happy and its their fault.
If they say that they will cancel it take it to the FSA and raise a complaint with higher management at Bikesure.
They are just trying it on.... In the hope that you will roll over and pay the diffrence.

They can charge what they like at the tills. Most of the time the shop assistant wouldn't care enough to bother, and if the difference isn't great the shop would probably just agree to avoid the hassle.

There have been numerous cases with people diving in to order things which have been wrongly priced online. In that case it seems that the shop is free to cancel the transaction up to the point they have issued a receipt accepting the transaction.

Kickstart is right although I will add that if a product is priced up wrong on the shelves and we refuse to sell it at that price we legally have to remove the product from sale for 24 hours before putting it back on sale at the revised price.

For the sake of a pound or so we don't normally argue the point however when it comes to higher priced items we cant loose out on £50 just because some dumb fuck stuck a wrong sticker on something Laughing the retailer does need some legal protection or there is nothing to stop a customer removing a price ticket from a lower value item and sticking it on another product.

People appear to be confusing advertising with pricing.

I meant if the price was clearly advertised on the shelf.
Not just a random price tag on a single item when the rest has a different price.

I can see the points though.
It wouldn't be a big issue for me anyway. If i get to the till and price isn't as advertised i'll either leave it or get depending on what mood i'm in/how thick my wallet feels at the time.

One of the reasons it doesn't need to be as advertised on the shelf is because of ticket switching.

It normally says on the ticket what it is.
if it says "tesco value toothbrush 11p" and you're looking at a 60" Sony LCD telly you're obviously going to know it's not a toothbrush and that it doesn't cost 11p Razz

There is absolutely no way they can change the price after you have paid and received the paper work.

Tell them to go to hell.

I presume the FSA regulate insurance for vehicles, give them a ring and see what they say, then repeat that message to the insurer.

But absolutely do NOT pay them extra money until the FSA or a solicitor (yours, not theirs) has said you have to!

For all you know they will ring you again a month later and say they made another error, you owe them an extra £150 again.

As has been said, ring the FSA.

Then ring the company back, and tell them you are currently in talks with the FSA regarding the matter, they will soon back down. Insurance companies absolutely hate the FSA, they could get fined £50,000 a time for something like this if they are found guilty, so they would much rarther let you off £150, then have to pay £50,000!

I'd assume that theres a clause in the T&Cs of your policy documents that basically says "if we cocked up , we reserve the right to....." blah blah ....

Fair point - you'd need to check the small print in the event that they've included a get out clause, but normally once a price has been agreed and a contract entered into, they can't later change the price.

I'd suggest that when you contact them, make some mention about Trading Standards, Citizens Advice Bureau and/or contacting a solocitor for legal advice, and see how they react Thumbs Up
