Has anyone had a letter today with a demand from the tax office?? Or have you had one saying they owe you some?

If so how much??

It all sounds like a massive balls up to me!

The tax man has 1 year to open an inquiry into your affairs. He can go back 7 years normally.

If he really wants to get nasty he can go back 21 years. Quite often the tax man will threaten to go back 21 years to scare people into admitting something they were innocent of. I got several tax inspectors reprimanded when they made these threats when I worked in tax.

I think the point here though is that it is their mistake. If everyone has supplied all the correct and required information and then the IR have calculated it incorrectly, I don't think you'll find the 7/21 year rules apply! Confused

They are the taxman, ergo an arm of the government. If the rules do not suit them they will simply change the rules. The merger or Customs and Excise and Inland Revenue was designed to faciliate this and to give C&E powers to the Inland Revenue..

Did you not hear of that case a few months ago? A guy was owed £7000 as a tax refund. He UNDERCALCULATED it accidentally HMRC slapped a massive penalty on his rebate which sucked up the entire £7K

Btw you can use a clause called A19 whereby you write a letter stating that you felt that HMRC and your employers did nothing wrong therefore YOU and YOUR employer did nothing wrong.

This is a special concession (will be removed of course as the government is skint) whereby the amount owed is written off.

As you can say it was based on HMRC advice that it is entirely reasonable for them to have known the correct tax codings and law therefore it was their mistake.

Ergo you are not at fault and therefore should not be punished for THEIR mistake.

My other half says according to the hmrc's own rules you don't have to pay.
They have to issue a demand within 12 months, this is why you get estimated demand if you fail to do a return on time.
They've not given a bill within their time limit so tuff.

Tell them to sick it where sun doesn't shine, sure we'll be hearing more about this over time

Actually my other half used to work for the HMRC, and by and large they are mostly people who can't find jobs anywhere else. There are a lot of sad, lonely people who have no malice in their bodies, there are a lot of temps and a lot of people who are just plain lazy but take a government job because they know it is next to impossible to get fired. There are a lot of military wives because when hubby gets moved from base to base she can transfer between offices.

However, not one of them is sub human scum, not one of them is a bully, I didn't meet any cheats, the thieves get sacked (about the only ones that do - and they are really obvious because they change their name by deed poll to I. Revenue). Gutless, yes a few of them, some of them are liars (generally about the amount of work they do) but really they are just a sample of the UK populace.

Everybody knows that the real sub human scum are those that direct the HMRC etc to do what they do, and those people aren't a cross section of society. In order to get to be one, you have to be a shark, and of course that is a Member of Parliament.
