i got a verbal only, no paperwork given to me.

Its my understanding that ive got to have recieved a hard copy within 14 days or it holds no ground, then a court date within 6 months?

Or am i wrong about this?

If they gave you a verbal NIP then that ticks the box for you receiving an NIP within 14 days of the offence, there's no requirement for them to also send you a written NIP.

So what did you do?

notification of intent to prosecute iiirc

they have given you a nip if they told you in person, they dont even need to word it like that. a friend of mine got one for riding a pizza hut scoote (when i was a manager at another store) and got caught by the police as the tard left the private lane behind the shop.

he received nothing in the post for around a month then got a court summons.

in short if they have all the time in the world to prosecute you now since they told you in person at the time. infact one of the drivers at my place got done 10 years after commiting an offence because he was told at the time he was going to get charged.

No. They don't have all the time in the world, how long they have depends on what he's (allegedly) done.

Traffic offenses that end up in magistrates court have the 6 month time limit. For more serious stuff, like dangerous driving, then that's a crown offence and there's a limit of something like 7 or 8 years for the case being put to the crown court.

drink driving has near 10 years (may have been 8 as the guy may have just rounded it up) driver at work got done for drink driving years ago and then got summond to court when he went to get a new passport or something like that.

if they say they intend to prosecute or charge you with something, it usually means that they will.

As Ste mentioned; it's 7 years if it's in a crown court (dangerous driving) but 6 months from the date the CPS received the details (not the date of the offence/nip, I'm pretty sure) that they have to get you a court date if it's just for magistrates (without due care and attention).

An unmarked fiesta, ffs the budget cuts must be really hitting the police down your way. They're still using big cars up here Sad

I'm always cautions of other cars, if they've been following me for a while then I usually turn in to an angel until I loose them or they turn off etc.

Cars infront is another matter though Laughing Shocked

little update. it gets interesting

got my court summons through the post.
got a date, and a police statement etc, which made me go Sad

until...

i get to the part that says:

''at 21:10 hours i heard a loud roar of a motorcycle as it negotiated the roundabout on one wheel, in a manouver which i would call a ''wheelie''

for starters... i was at work at 9:10pm. i clocked out at 10pm after working backshift, and would have passed through the area at around 22:10. witnesses and timesheets possible.

I also cant negotiate a roundabout on 1 wheel at 30mph no matter how awesome i claim to be.

He also identified my bike as having an orange fuel tank.
my ktm has a white/clear fuel tank with orange side panels.

Cool Mr. Green

Plead Not Guilty, give no more information than necessary either in writing or verbally in court, don't mention that you would have gone through the area at 22.10.

Just go to court, and produce your evidence that you were at work and your bike doesn't have an orange fuel tank.

Should hopefully be job done Thumbs Up

And don't mention this either Wink
