I'm thinking about getting an ER5 but am finding it very hard to come across a restriction kit for an affordable price. Although Im NOT thinking of doing this, I was just wondering what the penalties are of getting caught without a 33 bhp restrictor in your bike in the event of getting pulled by the police, and the event of an accident. I'd hazard a guess at riding without a licence and riding without insurance.

Is it really that bad? Didnt think police took it that seriously tbh. Rolling Eyes

Same thing as driving a car on a bike licence. Driving otherwise than in accordance with your licence. 3-6 points - with 6 being a ban within 2 years of passing your first test.

i guess since you would be riding with no insurance / licence they could also impound the bike on the spot and you would have to pay lots of money to get it back or let it be crushed.

As I understand it, the insurance company are still obliged to cover any damage to a third party caused by your actions....

Downside is, is that they then seek to recover their (very very very) expensive costs from you afterwards.

Aren't the restrictors on ER5's just washers? I reckon a google search would show up the dimensions for your bike (new shape or old shape btw?) in ten seconds flat. The parts should cost pennies....

6 points, so you'll lose your license. Get fined, bike impounded have to pay huge fees to get it back, and then an extended re-test.

However provided you don't ride like a tit or crash then chances are you'll not get caught. It's up to you to weigh up the risks.

Unless he posts a pic up of said bike on this forum, then a post afterwards claiming his 110mph run and no restriction at which point 15 coppers will kick his front door in, seize his bike, computer and all belongings and proceed with a criminal trial.

I passed my test 6 years ago and got an ER5. Which was restricted.

I sold the washers to someone on here for £10.

The ER5 handles the restriction perfectly. It really does. I would really recommend it.

It still pulls away fast and is more than capable on all roads including motorways. When restricted it accelerates quickly up to about 90mph. Then to get any more, you have to really really really try.

But the speed limit on the road is 70, so you'll have no problems.

But if you think about it, how can you be done for no insurance because the insurance company dont care whether it is restricted or not they charge you the same money either way. So just because you have no licence to ride the bike, it doesnt mean you have no insurance. You may have insured the bike but just not have the licence to ride it.

Of course they care. Firstly, one of the questions you will be asked is whether you hold a licence for the vehicle to be insured. In this case the answer would have to be "no", in which case you wouldn't get cover.

Next, insurance is all about risk and probability. The risks involved with a full-power bike are inherently higher than with a restricted one, even if the same model. The risks involved with a rider who is not qualified to ride a big bike are also higher.

The only way to get insurance in the scenario described is to lie to the insurance company about your licence. This would be insurance fraud, on top of riding without a licence. Whilst the insurers may be liable for third party costs, they would also likely chase you for recover of their costs.

I wouldn't risk it at all to be honest.

Someone on this forum got prosecuted for riding a non 33bhp bike.

Even though I was old enough for DAS, I had a 125 passed on that and waited the 2 years.

It wasn't an issue.

The absolute irony is that if you stick to legal speeds, the 33bhp limit is not an issue at all.
