Apparently they owe a lot of bikers money, and one lady dropped her bike off for repair and it was sold.

Anyone who had a bike in on a sale or return basis will be able to get the bike back from the new owners as they still own it.

The new owners would then have to try and get there money back from MSB.

Interesting post regarding this matter:

one thing that bothers me with this situation. If a bike had been left with Midland Superbikes on a sale or return basis and they sold it how can it then be reported as stolen? The fact is that they sold it ( as the sale or return agreement gave them the power and consent to do )then failed to pass the money on to the person who authorised them to sell that bike. This to me shouldnt involve the new keeper as the bike was bought legally with the consent of the owner as per SOR agreement. This then leads to the fact that they didnt pass on the money to the person who gave them the bike to sell. This seems like a case for fraud that hopefully will result in him after a conviction being forced to pay customers back.. i would be interested in anyones views

I think he has a point.

The contract between you and MSB will be invalid because you haven't got your money.

And the contract between MSB and New owner will be invalid as MSB did not have the right to sell it.

So you're still the owner.

The contract between MSB and new owner is fine, as MSB had permission and the rights to sell the vehicle.

The person who has supplied the bike, is now simply a creditor to the business.

Do admit, the owner did try to do my dad over with various bikes, had a nighthawk that needed new head bearings (supposedly on warrenty) he said he checked it and they were perfect. We even had a written statement from his own mechanic (awesome guy) stating there was obvious notchiness from the bearings. Only way we got it done was by the mechanic ordering the parts sneakily..

What bothers me is, that the staff have posted on their about losing their jobs.

Well fuck me but aren't they the cunts that sold the bikes etc... hard to believe they didn't know how dodgy this guy was when people would come in and ask for their money.
