Tyre not fitted, money paid... help?

I went to my local bike shop to get a new rear tyre on the morning of Friday 26th. I know the owner well as I grew up with him, so entrusted him with the money up front so I didn't spend it on other junk,

Was told to come back Saturday 27th of November afternoon to have it fitted...

Didn't manage to get there until half 4, closing time was 5 so told to return on Monday 29th.

-Returned Monday to be told the courier hadn't delivered it,

-Returned Tuesday, same again,

-Returned Wednesday 1st of December, still no tyre, snow everywhere, sliding all over the road as I have literally no tread, apparently the courier company wasn't running...

-Returned Thursday, shop shut for no reason, now the owner is not answering my calls or text messages, tried calling 8 times, leaving 5 mins inbetween calls, no answer,

-Friday: Finally got a reply when I said I wanted my money back saying "I will order the tyre tonight and have it ready for you tomorrow",

-Saturday, Turned up at his shop at 9am waited for 2 hours for him to not turn up again.

-Sunday, tried calling, no answer, blocked my number and he answered straight away but then realised it was me and hung up.

-Today, told him at 9am I came off my bike last night blamed it on the lack of tread on the rear (when it was actually my front end that went out) and I needed the tyre fitted today, 3 hours later he simply says that he will "order it today".... Apparently he will fit it tomorrow(?)

As far as I was aware he had the tyre 2 Saturdays ago??!!
And then many times throughout the week when he did and then didn't?!!

My point is, what can I do to get the git to hurry up and fit it?
I need that tyre and if I get pulled its 3 points and bye-bye licence...
Suggestions? Seriously.

He is a friend, but I'm also a paying customer and he is messing me around, actually making me risk my life.

Mmmmm, He has been a very good friend in the past and always got my parts at trade price and I only pay £5 for any fitting, regardless of if it takes him 5 minutes or 5 hours, so I can't complain, but this is just taking the piss really....

Don't fancy taking him to court, wouldn't know where to start/ what to say, legally speaking... Sad

The way I see it you have two options:

1.) You go there and wait until he's fitted the tyre. Don't take any bullshit excuses. If he says he has to order the tyre, ask for your money back and tell him that you're going somewhere else where the tyre is in stock.

2.) Just ask for your money back and go somewhere else.

If he's busy, then it's likely he's put your job on the back burner so he can actually make some money to pay the bills Laughing

If it's really concerning you then get your money back - if he's a mate and that busy he'll be fine with that. And then pay full whack somewhere else Wink

Get your money back and take the bike somewhere else; if he's a mate he won't mind.

I bet he's got serious cash flow issues, how much is/was it? and is the company ltd? There is an old law which allows you to take them to court and force the closure of their company over trivial amounts.

I've been there everyday for the past week, monday and tuesday he didn't have the tyre, wednesday through saturday he was closed and not answering my calls.

Sent him a text message and tried calling after 5 mins to see if his mobile phone was on, which it is, but no answer/ reply....

It's frustrating, will be popping there again tomorrow, luckily it's just round the corner, about 4 minutes, but it's about 30 seconds away from the police station too, so all it will take is one copper pulling out the station to pull me over for any reason and I'm screwed....

He is fine with the money, always buying new stuff, out winning 1st place trophies for his racing.

Don't ride your bike if it's in an illegal condition?

If you choose to do so, get pulled, and get points - it won't be your 'friend's' fault, it'll be yours.

BTW his behaviour has fallen well short of the mark on several occasions - I wouldn't want a 'mate' like that.

Sounds to me like he's about to go under TBH. Get your money back ASAP before you lose it.

Seeing that station is so close it may be worth having a chat and tell them the situation. Then maybe one of them while off duty can pop in for 5 minutes when it is open and just have a word about either getting your money back or getting the tyre fitted.

Mmmmm, I dunno about that, he has just spent a load of money on new bikes, and now has about 30 bikes in his shop, not bad for a 20 year old lad to have his own shop and no debt, his own 3 bed flat, a VW Van and every except the flat he owns... He has even paid for the shop property in full...

But I will wait until tomorrow to see if he gets this tyre or not, he cant stay closed all week, it's nearly crimbo and people want to buy pit bikes for kids/ themselves, etc...
I've got all week off though.... Twisted Evil

Ahhh, they are lazy gits, really lazy...

About 5 months ago my friend who I live with had his ps3 stolen from his room, I gave the police my USB memory stick with a copy of the CCTV footage, showing the lads who did it, but the case was NFA'd (No further actioned) about 3 months ago, been chasing after that memory stick for months..... still not heard anything....

Mate, I'd HIGHLY suggest you smash this up on PBC. Don't get shirty with the bloke though, just put your point across. He's a regular-ish user of pbc (pitbikeclub) a few people have had problems with him. Although its a minority.

Still, smack it on pitbikeclub, and see what his response is. He usually sorts these problems out (especially if they are on an open forum where he gets a lot of work from!)

I'll wait until tomorrow, then if nothing has been done about my tyre/ money being refunded, then he will get a proper bashing on there. I, being older than pretty much all the lads who ride peds/bikes round my area, will also lose him about 40 customers or more, seeing as they all look up to me/ look to me for advice. Dance!

Just wanna wait and see what happens for now... Don't wanna bash too much, he is still a friend, even if he is being a dick...
