Hi,

took my bike in to get heated grips fitting this morning they said it would only take an hour - he said he had 1 small job before mine but wont be long - that was @ 10am - its now 2:20 and they said that they still havent started it and it maybe tomorrow!

explained i need it to get to work but all he could say was "well it should be done but ill call you when it is"

whats the best thing to do?

Pick it up at the end of the day so you have it for work tomorrow and fit them yourself. They'll do the expensive jobs before yours.

Besides indicators/bulbs... they are probably the easiest to fit.

Are you really sure you want to pay a garage to do that for you?!

BUT

If you are actually unable to install them, just ask them and say you need the bike for tomorrow,you start the commute early and would like it done asap. It shouldn't take them long at all to fit them!

already done that but they didnt seem to be interested!

You have to weigh up the advantages and disadvantages of getting a dealer/mechanic/garage to do the job for you. This is one of the disadvantages.

Why is everyone i can help miles away from me, or am i miles from them.

I'd pick it up, if buying grips from them as well just don't buy them, get them from someone who values your custom instead of taking the piss and not caring about you having to get to work in the morning.
They took on the job on the basis you'd have it later in the day, saying "well, maybe later but likely to be in the morning if we can be bothered" is not good enough.
Phone and ask them if they will take the price of a taxi fare to work off the invoice if it isn't ready tonight so you can get to work in the morning.

just went down (got the missus to take me)

he said "oh its not ready yet......... it wont be long - 10 mins later he said urm....its urm gunna be a while like not ready today so will give you a cover bike -

Giving you a loaner bike is actually pretty decent of them. Hang fire until you see if they try to up the cost from their estimate - remember, until you're both happy, you've got a more valuable bike. Very Happy

they have never charged me for the loan bike before...

can i refuse to pay the extra labour? afterall they did quote for 1hour

Legally-speaking, i think contract law applies.
If they quoted (not estimated, quoted) 1 hour's labour to do the job, then yes, that's all you owe in theory. However, i'm doubting this is written quote so they can quite easily make up a new one.

My course of action if i was quoted an hour's labour and then it was changed without my agreement is to pay only for that quote (and make sure however you pay it's recorded that you've done so, so ideally a chip and PIN card transaction, or a receipt is if its in cash, saying that you have paid so much, even if they're not happy with it. Of course, i'd want the receipt writing out before i let them swipe the money Wink ) and then leave your name and address so they can take you to court for the rest (it's a civil matter then). This is what you do in a restaurant too. I'd be bloody sure they won't try and keep my bike though - if they refused to give the keys back i'd be looking to either take them back anyway (and would happily climb over the counter or whatever if necessary - but then i'm prepared to enforce my rights that way - although probably best to have a mate or two there if you're going to do something like that to prevent them ganging up on you and then making up that you hit them or whatever), or if i couldn't get the keys (e.g. they hide them away somewhere and won't tell me where), take the bike and walk it out of there, and sort the keys out myself. I wouldn't expect any legal recourse from those to be successful (Note: I'm not legal trained!). I'd possibly call the police with regards to the keys if they were being held. Of course, you need to decide what you're prepared to put up with regarding consequences, so act carefully. Personally, i'd feel pretty comfortable doing the above if it became necessary. It'd be easier to resolve it amicably however, even if you do have to resort to threatening the publicise the event or call trading standards.

Of course, it's also made harder if they refuse to accept part-payment (not 100% sure what i'd do if that was the case, possibly call the police to inform of the situation? - i.e. that payment was being refused and that you are trying to pay the original amount - to prevent them calling said police themselves and telling them you've ran off without paying and being believed!)

thing is they havent said they are going to charge more it was more of a what if they want to charge me more

so just to clear some things is it classed as theft if i only part pay(i.e what they quoted) and if they refuse to give me my bike take my spare key and just take it?

No, you own the bike. It's a civil matter if they dispute the amount you've paid. The fact that you part-paid (you are going to ensure 100% that you can prove you paid some rather than just ran off, right?) and left your name and address should prevent a charge of theft as it's a dispute rather than intent to permanently deprive. Have someone confirm this though as i'll reiterate, it's my understanding, i'm not legal trained.
