I remember reading somewhere, I think it was on Pepipoo, that all councils have to maintain a list of public roads. But it also includes private land that is subject to road orders. So, for instance, if you went the wrong way into a petrol station and it was on this list then you could be done, if it wasn't then you couldn't.

However, I can't remember the proper name for the document. I want to check out a newly built section of road at the end of a retail park near my flat, to see if it's okay to buzz about on on my go-kart. Can anyone think where I should look to find that information?

The road traffic act applies to anywhere with public access.

A road is public if there is no prevention access to it from another public road. Car parks are public areas.

As for the councils list of roads, they supposedly maintain a list, as I hear do the Police and Highways, but they aren't necessarily complete nor accurate. If you want to be totally sure about the presence of a road, check whats there for yourself with satellite images!

The list of streets only shows highways that are maintainable at public expense.

You can also get public highways maintainable by the landowner, although these are rare nowadays, usually dating back to enclosure days when a lot of boundaryless roads across moors and commons were hedged or fenced in. It was considered that if a local landowner benefitted from the newly enclosed fields he could bloody well keep the road fixed at his own cost.

I think you need the 'definitive map', which'll be held at your planning office- that'll have all the TRO's and rights of way marked on.

As others point out, the RTA may apply if the public have access. Whether that applies to a private road that has access from the highway as opposed to a car park where the public are invited in is another matter entirely.

Chances are the police'll enforce it depending on the road (with appropriate reference to the Hippies, Darkies and People Whose Face I Don't Like The Look of (Police Powers) Act. 1976, of course).

TRO is what you need, Traffic Regulation Order (or something like that). There must be one in place to enforce speed limits, one way streets etc.
It will be your local councils responsibility for minor roads. Major roads are down to Highways agency I think.

I reckon it's the Definitive Map you're after as Multijoy said.

A TRO is applied to certain roads to restrict their use, I don't think it's what you're looking for.

But as others have said, if it has public access the RTA applies.

Okay, I'll look out a definitive map as well. A list of TROs doesn't seem to cover what I'm looking for, but it is the thing I had in mind. In terms of the RTA, bear in mind I'm in Scotland so the extent of the legislation and the definitions of 'road' and 'public road' are all different. But this thread has been a big help, so cheers.
