no more bike

well this story starts at about 3 am when some idiot nicked my rear l-plate wilst i was staying at a mates now there is a grage about 5 min up the road from my mates (five min on a bike)
and we had planned a rideout the next day so i thought ill pick a new one up on the way so we gear up and set off at 11am
i pull out of a junction and a traffic copper clocks me whips round and pulls me by the time i had pulled over we were oposite the grage he checked my plate ect and everythiong was fine i gave him my licence as he requested and all he said was "ahh we havew a problem" i was confused having forgoten about my l-plate for the time beeing "wheres your l-plates?" at that point my heart sank
i explaind my predicemant to him and said "if you could wait here a moment ill nip to the garage and get one now as i was going to anyway..."
"sorry mate but i think im going to have to take the bike"

i was totaly shiting bricks

he radioerd it in and that was that he slaped me up with a fixed penalty notice 60 quid fine and 3 point's AND he siezed my bike

now dont get me wrong i broke the law and i accept that but surely the 60 quid and 3 points was enough? but to take my bike aswell! thats just harsh

or ithinks so anyway

now they want me to pay 150 quid to relese the bike and 10 quid a day storage

so i told them i would not be collecting the bike and went down to the dealers and put a deposit on an 06 plate cg

but anyone elce think that was just a tad too harsh
?
is there anything i can do about it?

First off, get someone that can write eloquently and professionally to help you.
Then get them to draft a letter to the appropriate local police boss and the police complaints commission.

Might get somewhere if you're lucky, though probably not.

If someone really nicked your L-Plate, you should have called the police. Seen plenty of people get away with no numberplate because they've reported it stolen.

the bikes only worth 300 and it was in a shit state i hadent had it long and the previos owner ragged it to peices it was a p.o.s realy but it was MY p.o.s and i loved it anyway

the reason for seizure was rideing otherwise in accordance of licence a belive but i was litteraly on the bike maybe 5 minutes and was going to get a plate thats what pissed me off the moast

i plan on writeing to the press about it i also have had my dad wrlite a polite email the the traffic inspector? i think thats his title

anyway im not happy but i suppose its a chance to get a reliable bike?

A copper caught me doing about 60 (Indicated on my speedo) and stopped me.

He asked what speed I did, then I lied and said I do not know. He said I could have done you for any speed right? But he said he's not a traffic cop and will not give me a fine. Then he looked at my bike and saw no plate, so I lied and said it dropped off.

He physically took off my front one and put it on the back seat. Really ncie guy.

i'm sure the officer has to follow a much bigger procedure and have more edivence to use section 59. Is there anywhere we can actually find the proper clauses of section 59?

I would sue them for harrassment, distress and loss of transport to and from work etc and most of all finiancally - has been done.

Unless you had no insurance and Mot then fair enough but for an L plate?! its usually a 60 quid fine and 3 points............

Doesn't add up really, if you could have produced an L plate from the garage, he would have no reason to impound to bike.

Back when I had an XR125, the rear plate used to brake off every few thousand miles. Usually I didn't notice for a good week or so. I was stopped twice by the police (the officer could see where it had broken away from the bottom of the numberplate). Both times I was simply told to get one re-fitted ASAP. No penalty, no fine.

Seizing your bike is an extreme measure under the circumstances. I thought they only tended to do that on grounds of no insurance.

Pretty sure police dont have to be leniant and let you go to a garage and get one, for those 5 mins of your ride you broke the law, luck of the draw you got caught.
and in all honesty it was slightly harsh but then, as you now know riding without L plates (as that is the law as stipulated upon when riding with a cbt) is outside the terms of your license, technically also making you uninsured due to license. Putting it bluntly you took the risk and it didnt pay off..

Yeh it is law but a pisstake. Not all laws are right.

I haven't had an L plate on the back of my bike for about 2 weeks because it snapped off. If that happened to me I would be seriously pissed off. Better get a new one.

From being on here and reading things, you were still insured and he only had the right to give you a fine and maybe points.

Although i have a usual sneaky feeling, that they can twist it to do as they please ....

Your legal, have the front plate on .. and he does that ... bang out of order ...

Are you known to police besides trafic offences ...

Also if you did not sign the bike over, i bet your still liable for the storage charges to boot ...

i am not liable for any storage charges as i have declared that i am not takeing the bioke back (i checked with them about that ) )

the only othere thing for me that involes the police is i am currently involved in a knife crime trial (i was the victim not the offender) wich to my belif is now ended
