I'm wondering. Does this count as advertising? They are after all, a private company trying to sell me a product (a TV licence) by means of direct mailing.

I'm tempted to report it to the advertising standards council for being deliberately misleading. To be clear, I'm NOT being taken to court because I don't watch TV and they can't possibly have any evidence that I do so. This letter reads like an NIP and would be taken as such by many people.

I can't see how it can be legal to send out letters like this to people who have done nothing and I feel the need to stir the shit but I'm not sure whos remit it comes under.

I thought the letters I've had so far were bad enough, so much so I've been known to throw a rager (in my mind) at the cnuts, but that takes the biscuit.

They're so above their station it's not even funny and possibly not even legal.

I find their letters to be an insult to my intelligence so I just throw them in the bin anyway. They can't even get my address right so to hell with them.

Can't help you though, I'm not clued up in all that legal jazz.


(I don't have or watch TV nor do I have any intention to do so, ever... If i wanted to feel my brain cells dieing I'd have a few beers and keep myself entertained that way)

I used to get them all the time in my first year of university. I even got the local courts jazz. Nothing ever came of it though.. I looked into the harassment stuff but they seem to be well above the law in that sense.. But at the same time there is very little they can do to actually cause you any hassle. They literally have to see you watching live TV through your window before they can get you from what I can gather.

So I just binned the letters and ignored them.

I didn't have TV for a long time, and consequently never bothered with a licence.

After receiving repeated threatening letters like yours, i wrote them a nice letter stating that if they continued to bother me i would be taking further action as i felt i was being harassed by a public body.

They sent me a declaration to sign stating i didn't have a TV (despite repeatedly already advising them of this), after that i never heard from them again.

In theory, TV licencing is part of the BBC, but they have their own administrators, based in Bristol.

I would start by writing to them and the head of revenue at the Beeb, who I imagine will be based at the concrete doughnut; might also be worth a line to Ofcom, who are overseers of all things broadcasting, although I'm not sure this is their thing.

Good luck with it though, this bunch of clowns are getting well beyond themselves.

That's all good but the thing is, you shouldn't have to declare that you don't watch TV. I dont see folk without radio ham licenses getting asked to declare they don't use it. I don't see people without car licenses having to declare they don't drive a car.

I can justify my existance without having to watch TV, it's not a fucking life necessity so why do they insist on me proving or declaring I don't watch TV.

DVLA have also changed their threatening letters, they now talk in terms of out of court settlement, rather than fine or charge. I suspect this means they cant legally fine you or charge you, and can only intimidate you into thinking there will be a court case and you'd better pay now to avoid paying more later.

Uh yer, they can actually take you to court for that (sucks I know). The problem with the DLVA (Apart from the fact SORN even exists) is they threaten and bully you to pay them when actually you don't need to, and consider themselves above the law.

Oh and also that they are incredibly incompetent...

Because of your post, I just took out the latest letter I received (today) from the TV Licensing people.

Initially I took it out thinking "I wonder if mine says the same as Stinkwheel's, wouldn't it be funny if they were just sending out the same letter to scare everyone."

Mine goes basically "We're authorising an enforcement visit and if we catch you ... you'll be sorr-yyyy!"

But right towards the bottom (and interestingly, right on the bottom fold, which means you can't read it very well), it says

"Remember, you are not saving any money by delaying your payment: your new licence will still expire on 31 October 2011."

I actually appeared in court for not not having a tv licence in August 2004 for my house in Blackpool.
I wrote many times & phoned them to let them know that I did not even buy the house until December 2004. Despite the fact I had documentary evidence that I did not live there I still had to appear before the magistrates. I was the last case heard on the day and the magistrates looked pretty pissed off when I showed them the solicitor's letters re the purchase of the property and asked why I had let it get this far Rolling Eyes I had records of all my contact with the tv people, magistrates then let me go whilst laughing at the situation Twisted Evil

3 years ago I got a visit from the tv people, they saw my tv in the lounge, but when I invited them in to see it they realised that there was no ariel connected and not plugged in. I have never heard from them since about a licence Very Happy

I rang them the other day, just for a luagh more than anything as I think they are pitiful and their thinly veiled letters full of absolute bullshit sound like they are written by retards. I don't know how they think they can get away with it but for some reason they do.

Anyway its a bit of a moral dilemma for me because the mrs works for a call centre so generally I'm as nice as possible but I made an exception this time. I phoned them from work, started off pretending to cry because I was scared I was going to court then proceeded to ask them how on earth a glorifed double glazing salesman was going to 'interview me under caution'. Then they asked for the reference number and my name, to which I gave the number but refused to give them a name and then asked who they were going to take to court without any evidence or an identity. I went on to tell them that should they send any of their commission based mercanaries to my house I will consider it trespass and exercise my right to use reasonable force to remove them. They hung up in the end.

Phoned back, spoke to someone else and this time I explained my situation and theyve suspended it all for 6 months.

Ive got an address to write to some shithouse who's supposed to be in charge of Liverpool and Cumbria who's name was on the letter I got last but I'll have to wait for the inclination to write to the (probably non-existant) scumbag.

The way in which they operate should be stopped. If I wrote a letter to someone accusing them of looking through my windows and saying I was coming to their house to check on them they would go to the police.

If I wrote to someone saying we know what you're up to so give me some cash or I'll send someone round to the house I would be arrested for extortion or blackmail.

If I did any of the above on a regular basis it would be considered as harrassment.

Most of all though what really gets my goat is they try to imply that you are guilty until YOU prove YOURSELF to be innocent. As if someone could be so preposterous as to not have a TV.

Just checking your tv is pluged in is not the only thing tho surely? The fact you have pc's to go on this website means you have acsess to bbc content having the internet is enough?

Plenty of students have been done for simply having a laptop, i know of one personally who got fined £1000 while at uni in portsmouth and he didnt own a tv...... He did however have a laptop and had been using the internet.

Video recorders and digital recorders like Sky+
You need a licence if you record TV as it's broadcast, whether that's on a conventional video recorder or digital box.

A licence covers you to watch TV as it's broadcast on a mobile phone, whether you're at home or out and about.

Meaning that if you use your laptop solely for iplayer or 4OD, and not for live broadcasts, you don't need a license.

We've got a marvellous collection of letters from them now. We do have a TV license, and I phoned them to tell them once. I'm not going to waste my time by phoning them again, and if they want to waste their time by sending someone round as they keep threatening to, then they're welcome Thumbs Up

So? If you don't watch BBC online then they still don't have a damn thing on you, was this friend at uni who got £1000 fine a total moron? Why would you pay a £1000 fine for something you haven't done.

The only thing they can do is get a log from your ISP to prove you've been streaming from the BBC one live server, problem is I doubt any ISP would do it because they have no right to know what websites you visit, your word should be enough. Like Villers say they just seem to have some kind of exemption for being allowed to accuse everyone of crime without any evidence whatsoever, the BBC and the way they operate is archaic and should've been buried long ago.

well im confused, i renewed mine about a week ago, i was considering ignoring it but i bought a new tv just after xmas and gave all my details etc and tbh didnt need the agro Neutral

You're not obliged to let a TV License Inspector into your home unless he has a warrant from the court. And the court will not give a warrant unless it has good reason to believe an inspector will be denied access. So in practice, every one gets one free turn to tell them to fuck off. Unless you're a complete idiot and you write to them in advance saying you won't let them in then they have no reason to believe access will be denied, until you actually deny them access. It's all there in the Communications Act 2003, Part 4, Section 366. Thumbs Up

What aggro do you get from picking up a brown letter and throwing it in the bin? You don't even need to open it these days - you can tell clearly when a letter has arrived from them. Laughing

Got another one, love their language a their sense of authority.

"We've tried to contact you about your TV licence several times. Despite this, our records show that you still don't have a licence. We're visiting unlicenced addresses in your area at the moment. Your street is high on our priority list"


They're practically saying I have to have a licence, sorry chaps, I ain't that susceptible to mind control. I'm guessing my street really isn't that high on your priority list as there's only a few houses, sorry chaps, scare tactics ain't gonna work either.

"Enforcement Officers in <your area> work throught the day, into the evening and at weekends. If they believe that an offence is being committed and cannot gain access to your property they have the power to request a search warrant.. Remember: they don't give up. If you're away from home when they call, they'll call again."


Good luck with that requests, chaps. I read the last sentence in a Hollywood voice-over voice for more effect but sadly I'm still sitting on the whole of my seat. Does sound a nuisance though, some overworked "Enforcement Officer" harassing me.

It's worth reading them for a laugh just before they go in the bin.
