Fair warning, I got spot checked yesterday by a police biker who tells me this is their 'theme' for March.
I'm also the first one he'd stopped that didn't have illegal tires/mods and was properly insured and taxed. ____________________ Previous: 2002 Honda CB500 (sold), 2007 Suzuki SV650SK6 (crashed), 2005 Yamaha FZ6 Fazer (sold). Currently bikeless

I keep my bike fully legal with insurance, MOT, & tax, and I always give it a check over to make sure it`s in good order ie tyres, chain, ect.
If they stopped me randomly for no reason, I`d ask them why and if I thought I could get away with it, I tell them to get knotted
There`s no spots on my bike so they dont need to check it!
what is it? cant they find any illegal bikers to harrass, so they think it`s a good idea to bully legal bikers?
Or is this a reminder that they are in charge and we need to know our place . ____________________ I am the sum total of my own existence, what went before makes me who I am now! |

Coppers can stop you without a reason.
There are regulations governing formal roadside testing, but they're weighted against you. Read the Road Traffic Act 1988 Section 67.
| RTA 1988 Section 67 wrote: |
67 Testing of condition of vehicles on roads.
(1)An authorised examiner may test a motor vehicle on a road [...]
[...]
(3)A vehicle shall not be required to stop for a test except by a constable in uniform.
(4)The following persons may act as authorised examiners for the purposes of this section [F191and section 67A of this Act]—
[...]
(e)a constable authorised so to act by or on behalf of a chief officer of police, and
(5)A person mentioned in subsection (4)(a) to (d) and (f) must produce his authority to act for the purposes of this section if required to do so.
(6)On the examiner proceeding to test a vehicle under this section, the driver may, unless the test is required under subsection (7) or (8) below to be carried out forthwith, elect that the test shall be deferred to a time, and carried out at a place, fixed in accordance with Schedule 2 to this Act, and the provisions of that Schedule shall apply accordingly.
(7)Where it appears to a constable that, by reason of an accident having occurred owing to the presence of the vehicle on a road, it is requisite that a test should be carried out forthwith, he may require it to be so carried out and, if he is not to carry it out himself, may require that the vehicle shall not be taken away until the test has been carried out.
(8)Where in the opinion of a constable the vehicle is apparently so defective that it ought not to be allowed to proceed without a test being carried out, he may require the test to be carried out forthwith.
|
Note all the getty-outy clauses. A copper doesn't have to produce evidence that he's authorised to perform tests (but must be authorised). You can ask for the test to be deferred, but the copper can carry it out anyway based on his "opinion".
And of course if the vehicle is "apparently so defective" then he's already spotted your bald tyres and credit-card sized number plate. There's no actual need for a section 67 "test" if the problems are obvious.
However, if your bike is or appears to be legal, feel free to insist on your right to defer any test. Good luck with that. ____________________ Biking is 1/20th as dangerous as horse riding.

Probably tempting fate now, but I've never been stopped on the bike in 6 years of daily riding...
probably helps that everything is legal, and I ride like a granny most of the time though lol ____________________ 1st bike (Sept'06 - May'10) : 1991 GPZ500S / Current bike (since Nov 2009) : 2003 Suzuki Bandit 600N

I'm not aware of anywhere that does sweeps for that, although individuals have been caught out.
Regardless of what the copper may believe, the onus is on him to prove that the bike is over 25kW at the crank, not on you to prove that it's under. However, if they have "reason" to believe that you're riding without a license - like you're making progress quite... briskly... - they can seize your bike (but not arrest you).
Some forces do occasionally do mass pedboi sweeps looking for 50cc peds that can do more than 50kph. Unless they actually caught you riding at speed, there's a far stronger case there to assert your right to defer the test. ____________________ Biking is 1/20th as dangerous as horse riding.

The TDM is legal, it has to be really the sheer volume of miles I do on it. The Speed Four and the KTM are less so ____________________ Well, you know what they say. If you want to save the world, you have to push a few old ladies down the stairs.
