Say someone rode a bike on the motorway that was only did 40odd mph like a moped or something, Is there anything you can get prosecuted for? seeing as there is no minimum speed limit on the motorway?
Can't you get done for obstructing traffic or something?

You can't take a 50cc on a motorway. That's illegal.

That's only 11 mph slower than lots of lorries and coaches that are limited to 56 these days to save fuel.

I would be careful. The cops could probably cook up something if you went really slowly on a motorway. Riding without due care & attention seems to be a catch all. Like the section 5 public order is - covers more or less anything minor if they want to nick you or stop you doing something they don't like.

That aside, it could be dangerous. I think twice about taking the RXS on motorways and that'll do 70.

The highway code has all of the exclusions, but as far as I know it's

Arrow more than 50cc
Arrow no non-engined vehicles i.e. bicycles, those silly old people electric carts, and milk floats
Arrow No pedestrians
Arrow No agricultural vehicles

I did about 30 miles on the M2 riding a C70 once. Top speed was about 45 in normal conditions. Just kept as far to the left as I could without actually riding on the hard shoulder and didn't have any problems. But it wasn't a comfortable experience, I have to say Confused

Must be at least 50cc, and a full licence holder of course.
Note that most mopeds are actually 49cc, so not legal on the motorway.

Also note that if you bore out a moped, you legally need to inform the DVLA it's not longer a moped (as the definition of a moped includes the cc limit), get it tested and approved as a motorcycle (££), inform your insurance (£££), and have the appropriate licence to ride it.

Fail to do any of that? Then ensure you like porridge, or at least lube up ready for a death by fining.

Full motorcycle licence, And yes I do actually intend to have it tested as a 75cc Smile I know it's more money but heck. It's my passion for some reason. Embarassed
EDIT: Doesnt actually need to be tested for a big bore...

Change to engine and cylinder capacity (engine size)

DVLA will need written evidence of any changes to engine number and cylinder capacity (cc). Written evidence can be:

•a receipt for the replacement engine
•written evidence from the manufacturer
•an inspection report provided for insurance purposes
•written confirmation on headed paper from a garage if the change in engine size took place before you bought the vehicle

Well, if you 'declare' the bore kit, and put the thing in for SVA to re register it as a 'motorcycle', you'll be fine, when the log book comes back saying its a motorcycle....

If you don't, and you take it on the motorway, and do 45mph..... Well, they'll as like nail your balls to a tree! (after they have finished laughing at your stupidity!)

"So you are admitting to riding a moped on a motorway, exceeding statutory speed limit (35mph at time of your bikes manufacture and still enforceable) for the vehicle. Failing to notify DVLA of changes to vehicle details. Failing to submit vehicle for Approval, hence riding vehicle in 'dangerous' condition, riding without insurance. And I dont know what else they could add to the list!

It would be like saying one thing to defend yourself would drop you further and further in teh crud!

BUT, get the bike re registered as a motorcycle, insured, as a 'modified' and all teh other crud.... fine..... wouldn't be NICE... but you could do it!

Used to have to drive an old Commer 'Walkthrough' van, on teh motorway, hauling a ruddy great compressor. Damn thing was governed at 45mph, and on hills fully laden, I could have got out and walked faster! It was perfectly legal. Annoying, scary, especially having artics tanking up on your chuff, but legal. Bit like my old Series III diesel Land Rover.... that COULD do 60... down hill, with a tail wind... and its only saving grace was there was a lot of metal in it, when you were crawling up a hill at 30, looking for yet another lower year, as another artic come steaming up behind, with another in the middle lane boxing you in!

Wouldn't REALLY like them going past me 10, 20mph faster, with no more weight than a push bike under me!

Let us know what it's like to be rearended by someone doing 70mph

Spent years working on stuff on the hard shoulder and the last thing i'd want to be doing is anything less than 60mph down the motorway, you will regret it if you live to get to the next junction

I recently drove a car (with turbo problems) on the motorway at between 40-50 mph not a pleasant experience I can tell you even got under taken by a impatient lorry driver, his overtake was blocked by another lorry so he moved onto the lane entering the motorway Confused , seeing as it was up a hill, the entering lane was quite lengthy but he still didnt manage to pass within that time so he ended up on the hard shoulder spitting dust everywhere until he got fed up then just cut me up with the last 10 feet of his trailer!!!! Shocked Thumbs Down


and this was a british lorry not sure of the drivers nationality or legality of his parents marriage!

I used to do 45mph in my old car. All that happened was that I was overtaken alot.

But I couldn't imagine how it would feel on a bike going top speed Shocked
