Hypothetical question here:

If a police officer pulls me over/stops me whilst I have my helmet + helmet camera on, under what circumstances (if any) can he/she make me remove my helmet or turn off the camera?

Doesnt look they they can. that video just shows that the officer clearly doesnt know the rules and just wanted to stop the cyclist from being able to document anything he does.

There is no official power to make you take your helmet off, however if the officer cannot confirm your ID ie check your appearence against your D/L photograph then the grief could begin. You then risk being arrested under the previsions of Sect 24 of PACE IF you have committed an offence as the officer can't confirm ID. Is it worth the grief. Tis also very difficult to hear through / speak through a helmet which could aggrivate the situation especially if you get stopped by a bike cop = 2 helmets.

Again no power to stop you recording the event, however if the police suspected that your camera contained evidence of an offence they could easily seize it under Sect 19 of PACE which is then bye bye to camera until procedings are over.

Whenever you watch these "Stop police" shows on the telly and some oik tells them to stop filming, does`nt plod always say something about it`s a public place and people can film if they want to.
Surely that must work both ways?
No Doubt the plod would try and force you to stop filming and take your video away from you if you did film them.

After all in the other you-tube video discussed on this forum it looked like that plod was going to attempt to take the video off the bloke.
Good job the bloke cycled off otherwise we may never of seen that clip as it might of got "accidently wiped"

Been there and done it. You can film anything you like in a public area, including cops. You can film them and your interactions with them up until the point you have been charged with an offence, at which point its at there discretion.

As a side note, the police cant make you delete anything on your camera either, they can however confiscate it under anti terror legislation.

Heh! Ive seen them use the excuse that you could be scoping out potential sights for an attack.

Its a load of crap really, just another abuse of police power.

I've no doubt that there are idiots out there annoying photogs for no obvious reason - however, be in no doubt whatsoever that there ARE people out there carrying out hostile recon for terrorist purposes.

I mean, they couldn't simply draw diagrams in a note book, or count the number of people going in and out of doors, or anything... or get architects drawings, street plans and 'stuff' under the freedom of information act, from the local library, planning office, or public archives!
And theres absolutely no OTHER reason for having a camera, which is why they are such a rare thing, I mean its not like half the bludy population carry one regularly, like they do a mobile telephone or anything........ Rolling Eyes

I wouldn't mind if someone was filming me...long as it got my good side! Only time I would possibly ask someone to stop is if I was taking someones details...just for their privacy...after that they can film away. (If it was someone else doing the filming, not the person I was talking to if that makes sense).

Agree with you on the Road Wars etc thing...has to work both ways!

You are perfectly at liberty to snap or film anyone in a public place (with a handful of notable exceptions), so long as you don't cause a nuisance, obstruction etc. Some cops think they can pull the 'commission of terrorism' bollocks to stop people taking pics of them but they can't, unless they have proper grounds for suspecting the person doing so is a bona fide terrorist threat.

How many people have been stopped and subsequently charged and successfully prosecuted for a terrorist-related offence that involved going out in public taking pictures? Probably none. Ever. But the cops use hysteria to harass photographers. The 'you might be a pedo' one is also common - another low life group highly unlikely to draw attention to themselves by going out under the gaze of the public and CCTV to take iffy pics.

If confronted by the cops, remain polite but firm. If you get bolshy they'll pull a section 5 public order. The grey area is that if a cop tells you not to film/photograph and you do, they can say and usually do find some fatuous reason for nicking you. Though the chances are they'll get their arse kicked if you make a formal complaint. A lot of photographers make more money suing the police for wrongful arrest than they do from selling their work.

Which bits?

Whilst the ECHR have found s44 of the Terrorism Act to be in breach, the legislation still stands until expressly repealed. s58 (the bit wot stops you taking a picture of a copper if you're a naughty terrorist) is unaffected.

As far as I can make out, everything else is valid unless I've missed a significant amendment to the Hippies, Darkies and People Whose Face I Don't Like The Look of (Police Powers) Act 1976.
