I got caught last month for doing 87 in a 50, I was given 3 points and a £60 fine and told to surrender my licence within 7 days.

I lost the plastic part of my licence over a year ago and my address has changed since then. The day after I was caught I went onto the DVLA site and tried to apply for a new licence but because of the change of address the site kept having a fit. I rang them and tried to do it over the phone but they told me I could only do it through the website or the postoffice.

It got to the 7th day and I still hadn't applied for my licence, so I popped to the cop shop and told a little porky to the lady at the counter. I told them that I had sent the forms off through the post office the day after I was caught, but I still hadn't had the licence back from them so was unable to surrender both parts.
She wrote it all down on a form and said I was to hand it in as soon as possible but that she couldn't give me an official extension as I was caught by the Essex police but I was at a Met police station.

Anyway I kind of let it slip my mind and still haven't applied for my licence. Today I got a letter in the post from the Essex police:

Essex Police wrote:
With reference to the above Fixed Penalty Notice I understand that you have not surrendered your full driving licence within the specified 7 day period. Essex Police are unable to extend this timescale and the fixed penalty must, therefore, be processed by means of a summons. The Officer dealing with this case will now be requested to submit information for reference to the Magistrates Court.

On receipt of the summons, you are at liberty to comment in respect of the factors that prevented your full driving licence being surrendered in the section marked 'mitigating circumstances'.

Whilst such factors will be drawn to the notice of the Court, please note that the decision of the Justices is final and cannot be directed by Essex Police.

Go to the court and apologise for being a dick, because you have been a dick.

Or, sort it out today (paperwork) and see a solicitor.

Not expecting sympathy, I know I've been lazy and stuff, just wondering what the best was of getting through it will be.

I was thinking that the original form could quite easily have gotten lost in the post?

Or is honesty the best policy?

Slightly off topic but would it not save everybody (the police, civilians, the DVLA) if there was just 1 database with everyone's licence details on there so that as soon as you are caught, the police can log in and see if you have a licence or not.

Would save sooooo much hassle and I just can't understand why this can't be done. The DVLA MUST have on record who has passed their test when so I'm guessing it's something to do with Data Protection but if this was shared with the police it would save so much time!

Hmm, so they've got the new technology to check it (I say new, this is probably a good few years old) but they still stick to the tradition of giving a producer. Sounds like tradition over efficiency to me!

All I can suggest is that you apply for a replacement licence. It'll cost you £20 but you could then try and claim that the delay was caused by your licence going missing in the post.

From the DVLA website:
When to expect your licence

DVLA aims to send your new driving licence to you within three weeks of getting your application. It’ll take longer if your health or personal details need to be checked. Allow at least 21 days for your driving licence to get to you before contacting DVLA.


Not far off the timing to almost seem a legitimate excuse.

In fairness the producer could have been to do with the points for all I know. I don't make a habit of getting pulled over so I don't know the standard procedure.

For all they know you could be pretending to be someone else... Hence the need to produce it.

Isn't failure to update details also a offense......

Just think by your failure to update the DVLA over the loss of your licence could have seen someone else using it to avoid points on their licence and you getting shafted big time.....

honesty is your only option period, if you turn up in court attempt to do anything but tell the truth about what actually happened and are caught out in anyway your going away for perjury. tell them the truth about being lazy etc. and forgetting about the paperwork and aslong as you produce your documents in court on the day and they were valid at the time of the offence apart from the fine for failure to update details you'll probably be let of with a bollocking from the bench, ive also forgot to deal with requests from the police and ended up in court it happens aslong as you can prove everything was legally in order at the time they are generally happy to accept wasting your day and making you travel to court as just punishment

You'll be summonsed to court, plead guilty, tell your little sob story and request the same punishment as the ticket, which you would have paid if you had your licence.

Should be ok.

You can probably do all that by post without actually going to court aswell.

Erm go to the DVLA right now in sidcup, which is along the A12 towards my way, and a bit further.

As for what you wrote, I didn't see anything written fron the DVLA. I didn't pay a speeding fine for about 6 months and then I was sunmoned.

You'll be OK unless the DVLA are efficient now. Sidcup DVLA are nice ladies, just go there, pay and wait for a new one. Also bring proof of id and address such as a utility bill. Erm check their site what else you need to bring.

I also had a problem with the change of address on my license as I lost my V5, and counterpart. I couldn't pay for roadtax and also left that for about 1 year until I got caught by a van. Sidcup sorted that out real fast for me.



I am free tomorrow if you want. I can take you there sort of, but you know I am bad with directions.

Sorry I just read it again. Just woke up you see man! Well, you have a police summons I take it. No idea what it will be, but a fine of 60 or 70 for court fees is likely. They will ask you if you have anything to say, so be honest. Wear decent clothing!

If I was you, sort ot your address and license, and tell them the effort you have made since then.

Hope you get it sorted. I was caught doing 88 in 60 weekend before last. sent the nip back confirming it was me. waiting now to see what points/fine i get hit with. Hope i get 3 points and £60 fine but ive been shitting myself in case i get hauled into court over it. Fingers crossed.

I take it you've never heard of the Police National Computer? Or simple things like radio persons checks. This new technomalogical hoohah. Wink.
