So im coming home from college to visit the grandparents and walk their dog before going home to see the girlfriend....when i come onto a round about and i am fully established on the round about a 17 year female pulls out BANG! straight into the side of her bike is wrote off her car no long has a door and every panel on her right side neeeds replacing or touching up he window was down (now shattered inside door) as ive hit the car ive flung off the bike gone head first into her! rbounded off and landed on the grass island sootd up punched the sign in temper and flung helmet at the car when...i see her crying her eyes out in pure terror in her car....

17 had her licence 2 weeks mommy and daddy braught her brand new car fully comp!
she admitted liability best bit was the car behiend her was a ambulance and a car oposite us on the island was a fire man who owns a zx6r and straight forward said it was her fault she didnt look or anything!

Now i was going to put my bike on ebay tonight but since it now has not a single untouched cracked or destroyed panel and a exhaust hanging off no headlights wing mirrors indicators gear level bent forks and handle bars i dont think that'll be happening...put a claim in (im 3rd party shes fully comp) for my bike my helmet (ruined) my jacket(ripped) (my trousers (ripped) and mobile phone (crushed) and ruck sack (ripped)...

Ive fell off a push bike and done more damage...ive got a bruised thumb a tiny cut on my foot (less than a centimetre and a fair bit of pain in my left arm (muscle damage feels like ive being punched by kimbo slice)


MCE are getting in touch with me tommorow to go and collect a courtesy motorbike (fingers crossed not a moped) and have said they will deal with my claim if that fail's it will be one of the 'had a accident in llast three years that wasnt your fault, no win no fee' type of things


obviously at first i was gutted bike ruined and biking career over! however no i see it as i should be fully funded for all the damaged items and may even get more for injury's if i feel i have whip lash tommorow....

i was planning to sell the bike to get a zzr 600 or zx6r and do my mod 1/2 anybody think i will still be able to do this? going to upload pictures in 2 minuites and will draw a diagram of what happened.... Rolling Eyes

Same way as everyone else, first they learn to pass the test, then they learn to drive, usually having various prangs along the way.

Glad you're OK Ash, now get as much as you can from the insurance, everyone else is doing it, you might as well.

yeah to be honest, my neck is starting to hurt but at the scene i felt fine except i couldnt write my details in neat handwriting due to the shaking....

now my thumb is throbbing and so is my foot and neck is starting to hurt ever so little but ive already been to the doctors 20 mins after the crash and told her my neck and head was ok and it was just my hand and arm..if i go back now claiming more injuries surley it'll look like im trying to make abit more ££££

cant find my USB lead right now will upload pictures as soon as possible...

Really hope i dont get a 50cc as i have to travel a long distance on the bike to and from college and the girlfriends most days Sad

You helped loads would have been lost without you as neither of us knew what to do at the time....even her boyfriend who came like superman backed my case he was like OMFG as if your sooo lucky Rolling Eyes People who look at statistics and see more bikers die think we all die in our first crash kind of person Rolling Eyes

Not necessarily, adrenaline is a wonderful thing, it masks all sorts of injuries for ages.

The thing to do is go back to the doctor in the morning and get a referral to the hospital, preferably get some X rays done.

As for whiplash, it's incredibly difficult to disprove, just be prepared for a long haul; I put in a (genuine, but mild) claim for whiplash and it took a couple of visits to a consultant and about a year to get the money, but it was worth it.

how much did you get? and how long did you have whiplash? before ive had it much worse than this,but after a week of pain killers it was practically gone....

ahhh hard to estimate a difference with yours being over 10 years ago....

my bike is insured for £2500

i paid £1000 for it and it didnt run too well and needed every fairing painted and repairing and new screen and new indicators/wingmirrors

so it cost around £1250 in the end ( i know a spray paint shop personally) and the going rate on ebay for second hand ones ranges from 1300-2500 depending on condition....

so including all my clothing, and my phone i would be over the moon with £3000 as this would pa for a new bike new gear new phone and my full test ...

i would be happy with £2500 but i think any less than that i will have to struggle to get what i had, by strugle i mean search for cheap bargins and what not which i wouldnt be happy with

A personal injury claim is on top of any repairs/replacements the insurance pays for, but, as with all things in an insurance claim, you have to back it up with evidence.

So, back to the quack in the morning, get your X rays done, then put in your claim.

You'll get the bike/gear bit sorted in a few weeks, the PI will take longer, but it's worth it.

And then i should do a personal injury claim, out side of mce so via a different company?

Dont forget to include "loss of leisure time" in your claim.

My mate done it when some bint backed out of her driveway without looking and took him out.

He got 2grand on top for loss of leisure time Very Happy

point of the thread though was do you think i would have being better off nt crashing and selling the bike or crashing and claiming?
also when the insurance offer me what ever price they get im going to say yes, if i can keep my bike still/if they say know ill say what about buying it , heard they sell your scrap bike back for less than £300 in most case's and i would easily break my bike and make more than 600 yamaha dt engine ad lots of still ok parts Thumbs Up

Its doubtful you would get a decent price for you bike on ebay.
Atleast now you can argue full value of the bike, including any mods on there.

Leathers, lid, gloves, phone etc etc must now be replaced like for like.

All brand new stuff, and thats gonna be pricey

You could do very well out of this if you play your cards right, stay cool and dont get all "caught up in the moment"

Stay level headed and make a list of everything that is damaged, the value of new replacements, loss of earnings and leisure time, injury, distress etc etc.

Keep cool, dont get over excited.

Anyway, insured price of the bike matters for nothing as that's evaluated according to current market value by the insurance company. You have witnesses, but make sure all your shit is in order so they can't try and offload the blame to you, which they WILL try to do.

Theres no way it could be my fault even if they do try i the crash happened parrelel with the point see entered the island i entered the island about 12metres away from here so there is no way i moved that 12metres in the time she moved 2 foot Laughing

Plus the witness ect

woke up this morning whip lash has kicked in pretty bad going doctors latter tp report that in as well and the insurance have asked for pictures of cuts and bruise's which i dont have many off to be honest not any that will show up well in photo's

Glad you've come out of the crash Ok but maybe your money would be better spend on further training after doing your Mod 1/2. A little tip is to always try and make eye contact with drivers at junctions or at least look at them to see if they are looking. If they are looking ahead then it's on the brake straight away.

Driving a 125 with a gung ho attitude is completely different to a bigger bike and as you say you'll end up 6 foot under.

Glad to hear that you're relatively unscathed.

Just the usual warning: regardless of what was said at the scene, by the time her insurers are done coaching her, she'll have been sitting motionless at the junction and you crossed the carriageway at 80mph and deliberately rammed her. While pulling a wheelie.

Have you written down everything that happened, and drawn a diagram? Did you get all the witness details? Have you given them to your insurer? And also, since you're 3rd party, you might be as well going via an independent outfit e.g. www.sorrymate.com.

Hope it works out OK for you.

ash mate, hope your alright pal, and my mate got about 1500 for his injury claim and all he said is he got a bad leg, whip lash and small things like that. took about 6 months

i feel bad for you, all that work you put into that bike mate, fixing it all up and some idiot ruined it! Thumbs Down unless you got rid of the gilera?
