Gatso and Tax

can someone help settle an argument - if you get flashed by a normal Gatso camera on a un-taxed bike, would you get done for not having tax?

Not usually, it depends how deep the relevant safety camera unit digs into the records. I would suggest that an untaxed bike usually wouldn't get picked up as that info comes from elsewhere.

If the bike is not taxed and not SORN then the DVLA will automatically send you a fine. Don't think it matters whether or not you're speeding!

The bike in question was bought on Thursday, insured on Friday, MOTd on Saturday, flashed tonight, (Sun), but couldn't be taxed online, (green slip only) , so was left until Monday to get at the Post Office. It was SORN.

Silly question, but couldnt you have taxed after MOT? Our postie is open till 4 on a saturday... thought you could tax with new keeper slip, insurance n mot cert?

No it wouldn't. The OP rode illegally and (I think) knows it. Tax doesn't 'back-date', it runs from the time you bought it (or from the expiry of the one it is replacing) until its expiry.

'Back-date' was probably a poor choice of phrase - what I meant was that it would depend on whether the tax only expired at the end of last month ? I was under the impression you get an (unofficial) leeway of about 5 days at the start of the month to get the tax sorted, provided there was no period of being untaxed ?

It was SORNed, there's no grace period.

Try not to sweat it until you're actually accused - the GATSO may not even have film in it.

Don't worry about it unless you were speeding in which case you'll find out within the next couple of weeks, should they pick up on the tax I would say they could possibly check the tax and as you've now got it and paid for this month they normally would'nt bother. I hope you don't hear from them and as I say all you can do is wait and see.

Well the camera did have film in, recieved fixed penalty on Saturday No mention of tax as yet. 38mph which at least means I know my speedo is accurate. Must get another camera detector, or take the one off my other bike
