... Anyone think I would be able to appeal against my using a bus lane when I wasn't allowed on the grounds that cycles were allowed to use the lane and on my log book it clearly states that the vehicle is registered as a bicycle... as does the tax disc.

I need to either pay the £30 or send in the letter with my explanation of why I shouldn't have to pay.

Google it. Or try Pepipoo, buy I'll be stunned if it hasn't already been tried.

Go for it, whats the worst that can happen.....you have to pay £30.

Just so you are aware that vehicle classifications are different under the road traffic act than the vehicle excise act

The thing is I'm a bus driver that uses the bus gate on a regular basis, and about 150 yards before where this 'crime' took place is a bus gate that allows everything through. At the point I got the ticket it clearly states buses and cycles only, but taxi's, police cars, vans, bikes, motorbikes and sometimes the occasional bus too.

I can't find the pictures of the actual ticket online, but only one of them shows me in the lane, and even at that I could have been going to park on the pavement or something

Although its taxation class is "bicycle", a motorbike is defined as a "motor vehicle" under the Road Traffic Act.

Come what may, you were still in the bus lane. If it were me I would just pay the penalty rather than looking to sneak out of it on a technicality and risking it costing more when it goes wrong.

The actual classification is "Motor Bicycle" but only bicycle will fit on the tax disc.

You have no grounds for appeal if that is your only reason.

It has been tried many times and every time the appeal has been thrown out even to the point where it went to the High Court and it was agreed that stating bicycle on the tax disc is insufficient grounds because it is known that a motorcycle is a "Motor Bicycle" powered two wheeler, not a bycycle as in operated by pedals.

That said, if you were say on an old pedal moped thingy... could you state you were pedalling and had the engine off? Laughing

Challenge, challenge it hard! Dollars to doughnuts there'll be at least one thing wrong with the road markings, the camera operators statement, the certification of the cameras or the signage.

You may enjoy https://www2.dft.gov.uk/pgr/roads/tss/tsmanual/ as some bedtime reading.

(Also, £30? That's cheap! Come to London, it's double that even with the early payment discount!)
