basicaly in december i sold 3 bikes sent all v5s off together recently i have been geting letters for fines about not taxing them

i rang dvla thay said to send a letter to them stating when i sold etc

i asked hetr about fines she said i could apeal them then i rang

the number of the money recovery company basicaly she said its may fault thers no way of geting away with paying it as i should of acted on not receving an acnolagement letter

Hi

Check the thread Paddy made, and Sickpups comments.

Basically you are required to tell them. To do so you post the forms. If the forms are posted then legally they are deemed to have been delivered unless they can prove otherwise.

Any claim by the DVLA that you should have chased it up is irrelevant. That is just their own procedures which they are in no position to enforce on others.

If you have sent the forms then you have complied with your legal obligations.

FFS, not this again.

Your legal responsibility ended fully when you posted the change of keeper slips.

The DVLA have their own opinion on that, but they're wrong, and they've been told so by a Big Boy court.

The DVLA cannot "fine" you. They can only demand money.

Tell the debt collection agency to go suck a sock, and you'll see the DVLA in court.

Then search for "sickpup DVLA" and get all the information you need to whip them.

Just tell them you posted them when you sold them, no your fault for not following it up, you fulfilled your end of the bargain shoving it in the postbox.

They might take you to court... they might not. I refused to pay...and I went to court Tuesday. Not the best day of my life so far Wink But they looked silly when the magistrate noted that it was a very old case.. (2009)

i was reading over that i rang the det colection pepole thay said it would go to court and would cost me 1000s

Oh that's OK then, some company with a vested interest fed you some bullshit, so roll over and stick your butt in the air.

Or do what the other posters have told you, read up, do some research, and realise that the DVLA do not have a legal leg to stand on. And remember, if they do take you to court and you don't come over all stupid and fluff up defending what is a clear black and white not guilty, you can claim your costs back off them (make sure it's down as a day off work to attend court etc). Yays!

scare tactics. it wont cost thousands if you lose.
Mine didn't even make it to court. The woman bailed 5 minutes before because of my statement posted in the other thread.

I'm getting done for failure to SORN too, soon. You're a plymouth geezer. know anyone with a white really old KTM registration M728 UKE? That's my old one. Trying to do me for it when I sold it to the breakers over 2 years ago.
