Dropping the missus at work today, popped in with her for a bit, came out and... Parking fine. Evil or Very Mad. Signage is there... but high up, and I'm short, so didn't see it.

£75 if paid within 7 days, otherwise £125. And: £4.50 charge if I want to pay by debit card.

I'ma guessing there's no wriggling out of this one? Even if I make up some bull shit about her being late, me offering to give her a lift and coming in to fetch her leathers because I needed to take another passenger that day? [/bullshit].

Yep. Elite Management (Midlands) Ltd.

Willson

Edit: Ooh hello! Ticket says seven days for a reduced rate... website says:

Elite Management Online wrote:
Once a penalty has been issued the driver has 14 days in which to make payment of the penalty at a reduced rate.

What's that about then?

If so, put it in the bin with all the threatening letters you get, or even better, the recycling bin.

I got a "ticket" (or should I say invoice Wink ) from one of these outfits and I just ignored it, it has now gone away.

Did they not recently change the law so that private firms cannot charge parking fines? I may be wrong, maybe it was just clamping.

They'll go to the DVLA to get the name and address of the registered keeper, i.e. you so they can send their threatening "pay this or we'll take you to court letters" I ignored it and my "fine" went up to something like £250, then a month or so later they tried a different tactic "we'll let you off x amount if you pay it now!".

Suppose it's economically viable for them, for every person who realises they're a set of scamming twats, another will pay them.

In short, it's a private matter and they can't do shit.

Agreed with above, bin it and don't respond to any letters. Only if you get a fine from a council will you have to take due action, private companies are unenforceable.

No envelope...

At any rate I lovingly ripped this off another forum:

Someone on another forum wrote:

In my view The Unfair Terms in Consumer Contracts Regulations 1999 apply to private parking tickets.

This is what the regulations say:

5 (1) A contractual term which has not been individually negotiated shall be regarded as unfair if, contrary to the requirement of good faith, it causes a significant imbalance in the parties' rights and obligations arising under the contract, to the detriment of the consumer.

(2) A term shall always be regarded as not having been individually negotiated where it has been drafted in advance and the consumer has therefore not been able to influence the substance of the term."

What's more, contract law means that the agreement is with the driver. And you weren't the driver that day, were you? Who was, they ask? You're not legally obliged to say Laughing

Also, they can only sue for their actual losses. They can't claim punitive damages. So for example, in a free car park, their actual losses are £0.00... So if they win in small claims court, they can claim their £0.00 only from you, and maybe the £30 court fee, that they had to pay to bring the case in the first place (in other words, no company would ever do this as there's no way to win).

Full of holes, full of holes.

This was big locally recently with 'parking eye'. They tried it on in a local carpark without much notice and changed it from all day for free to a 1 hour stay. Cue loads of people getting tickets etc. There were a fair few who paid them too.

I think if you look around for the name of the company on google and places like moneysavingexpert etc you will find a list of the letters they send you and what to do.

Normal course is: Initial letter with ridiculous fee (note fee, not a fine), another letter asking for more, a letter threateninglegal action, a letter from debt collector (normally from the same company under a different name and no legal powers) then normally peace.

Dont sweta it, dont pay it and dont even try the usual baiting (which is very tempting) as contacting them will suggest guilt and they'll get the bit between their teeth and send you even more toothless correspondance!

You could always send them a load of empty envelopes with no stamps on, meaning they would have to pay to get them from royal fail, thinking they were idiots paying up, only to find 'Wanker!' written on the inside of each one!

Couple of hundred should do it!

Just ignore it.

They can't do fuck all.

If it was the council, you'd really have no choice but to pay it, but with private firms you don't have to do anything.

They all act on scare tactics to get people to pay them, nothing else.

If everyone decided not to pay parking tickets from private companies, most of them would be out of business. Laughing

+1

I parked in the disabled bay of my local sainsburys and for months some parking company insisted that this meant I had entered into a contract with them and owed them money as if they had the right to issue a fine although they avoided using the word fine.

I never responded to them, some people thought I'd get done, but its been 3 years now, and nothing has happened and they gave up sending letters 2 years ago.

I doubt i'd park in their disabled bay again, but think they have mislead thousands of people into giving a donation.

My brother got a parking fine from a random private firm when he forgot to put his college parking badge thing in his car. First they'd send a letter every week, then the letters even came in red envelopes! Ohhh, scary stuff! Fast forward to now and they must have given up as haven't heard a thing in months Rolling Eyes

no, this was another company not sainsburys, as the car parks at this shopping centre are managed by the shopping centre not the stores

+1 to the 'Just Ignore it' camp

I've had a couple and just ignored the fuckers and they just go away after a while.

They threaten all kinds of stuff to do with your credit rating, but they never actually put their money where their mouth is and take you to court.

I got some of those pouches if you'd like another one.

Ignore it. I've had 2 after someone driving my car fell asleep in services for a few hours. ignored them.
They seem to have given up and gone away.

These days i just cover the front number plate to pass the anpr cameras at the exit
