I was just wondering if I were to crash whilst exceeding the speed limit and the police proved it and/or prosecuted would my fully comp still cover me for my bike and personal injury cover?

I've googled it but not found any mention of it....I'm leaning towards you not being covered as the insurers like to avoid paying out and maybe,this time,they might have a point.

They'll only pay out third party costs and may come after you to reclaim the costs.
Or so I understand.

Speeding would probably be dealt with under 'driving without due care and attention'; they'd make decision that speed was a major contributing factor of the incident and rule against you. Insurance would probably wriggle out of it completely and you're in a world of pain.

I was thinking about that the other day.. Looking at getting some kind of camera and was wondering if you'd been speeding prior to a car pulling out on you how much it would go against you.. I'm tpft so the personal injury injury from fully comp isn't applicable.. But whether it would affect the third party liability and pay out to you, I'm not sure how that'd work?

I should think you r bike will be paid out but if you added personal injury onto your policy you might suffer a reduced payout due to the circumstances.

You really need someone like TC to give an opinion on this.

Nah you will probably be covered, though the more insanely extreme the speed, the more grey it becomes I suppose. As for third parties, they have no choice, all they can do if considering trying to reclaim it from you.

Back when I was 17 (long time ago!) I hit a car that pulled out on me, I was doing 50 in a 30 zone (no moralistic views please as that is what the flow was doing). My insurance paid out in full, or rather his insurance paid out in full!. But that was, I think, due to it was his fault. If you just came off it on a corner for instance, then I think they would try to get out of it.

Is this theoretical? If so, why are you worrying about it? Most of the time you're not exceeding the speed limit, and I'm damn sure that worrying about your insurance isn't going to stop you from doing so.

But people may reasonably (even though it doesn't so much seem to be the case in the real world) think that they're much more likely to have an accident when exceeding the speed limit.

Personal injury cover on any bike policy is pretty rare.

If you crashed by yourself and injured only yourself I wouldn't have thought the police would even be bothered about investigating....depends how badly hurt though I guess. You don't have to report it if it's only you involved. You only have to report the accident if a third party is involved IIRC.

Broken arm, just ring up a mate and get him to come down with a van and drop you off in A&E on the way home. Wink

Firstly, the only way the Police would consider a full accident investigation after a crash is if there was a fatality or catastrophic injury, so the chances of being prosecuted for excess speed post crash is pretty remote and even then it would be for careless or dangerous driving.

If you were involved in a crash with another vehicle, it is not for you to prove that you were under the speed limit or riding at an inappropriate speed, it is for the third party to Prove that you were exceeding the speed limit, and again unless a full accident investigation has taken place, this is unlikely.

If you were involved in a single vehicle crash and you suffered injuries, the Police would be obliged to attend, but again would be unlikely to carry out an investigation.

So, short answer to your question, Yes, with FC insurance you would still be covered, and they are obliged to cover third party claims regardless of any fault or prosecution.

This was purely theoretical as I've yet to ride my Bandit and won't till I've got my full licence.

Just wanted to know where I stand on the issue as it's easy to accidentally go 10 mph over the limit without realising you're doing it and I like to know as much as I can about everything I can before I need to know it ...............those 7 P's again Wink
