I have recently had a bike accident on the M4, which has turned out to be a total loss.

I was with Bennetts as my insurer, and as stated on their website, here: https://www.bennetts.co.uk/bike-insurance/whats-included/ , All comprehensive policies include a replacement vehicle if yours is written off in the first 6 months.

I'm now told that I don't have this cover as "not all their underwriters offer it".

To me, this is a clear case of false advertising... be careful when purchasing a policy from them!

Meh insurance companies, they'll worm out of everything and anything..... it probably said something in the microtext subset of the fine print tbh.

Yes it clearly states on the Bennets' web site

Oh you are probably right, I'm probably also not covered if driving on a tuesday, or whilst alive. :/

Still, I purchased the policy on the basis of their advertising on their website... and websites are now in the remit of the advertising standards agency.....


So I've lodged complaints with the ASA and the FSA Smile

Check your policy doc's. They will supercede anything on the website....

Might be worth a word with them.

I'm assuming that your bike is under 6 months old. If so then start the below....
But skip straight to the written stage as you have already called them and registerd dissatification....

You were right, until very recently, when the ASA took on responsibility for websites.

Yeah, the bike was 4 months old, and I have started the process!!

I mostly just wanted to make others aware they may not have the cover they were sold....

That's their problem, not yours. Your contract is with them, not with the underwriter.

They'll tell you that it's not in the policy that you bought, they'll tell you that you have no case against them, but that's just their opinion. A court may disagree.

Now, the total value is likely to be above the £5000 small claims limit, but what you're after is the difference between what you actually receive and the full cost of a brand new replacement.

Don't dick around with their complaints procedure, don't accept their story, just send them a Notice Before Action and then kick off a county court action. Expect to get a call the night before your case is due to be heard offering a settlement.

Hm, I have GAP insurance anyway though, so my actual losses are only going to be the cost of the GAP policy (as I could have transferred it to a new bike) and the cost of 8 months insurance (as the policy would have been transferred to a new bike if it had been replaced).

Still, I like this idea!!

my other half reported a firm of window suppliers who added VAT onto their advertised prices with slogan saying "the price you see is the price you pay"

they got fined thousands in court Thumbs Up

No, the contract is with the underwriters... They are providing the cover NOT Bennetts who are nothing other than a broker, same as all the other co's who advertise bike ins....
This is the whole reason you MUST CHECK the policy doc's you recieve.

Be very carefull taking any court action as while you may win the case, getting any money out of them is not as easy if they fail to contest the case.... That means you need to go back to court and get a order passed to get baliffs involved to collect the money. Which all takes time effort and money.

Far better to take the FSA, ASA route and let them sort the issue out.
Result at best will be a * stating depends on underwriter.
