One of the lads at work came in today . We get paid weekly so he's gone to the cash machine to check his balance and found 2.5 grand in his account.?

Anyway he wants to know what he should do , I told him to ring his bank but he's said he's gonna leave it.for a month or so and if its still there he's gonna spend it .

Opinions please ?

He doesn't have a direct debit set up for the lottery, or something like that that would explain it's appearance? Or is he able to see exactly where it came from by using internet banking/an account managing machine like they have in Barclays so he doesn't have to ask someone behind the counter directly and alert them?

Bad news is, is that if it's bank error it's still not his to keep AFAIK...

Get a statement, see where it is from would be the first thing to do. Don't spend it.

If he holds onto it then I think that it may be considered theft. Whilst the banks don't mind taking monies from us, they no like if we do it to them.

Happened to my old man, the DWP meant to put £400 in his bank and missed the decimal. He had £40k instead.

Bank told him to move it into a high-interest account and give it back when asked. I told him to spend it (he was dying of cancer). He gave it back the next day.

Bloody glad he didn't listen to me as I found out when he died that the only debt that doesn't die with you is over-paid pension.

Once its credited your account they can't take it back without your permission (we have a nightmare when customers send payments to the wrong accounts and don't notice).

IN THEORY: the liability rests with the bank. Assuming that its not a ludicrous coincidence and the funds were payable to someone with the same name the bank shouldn't have allowed the funds to credit your account without confirmation that you were expecting the funds.

IN PRACTICE: It'll depend a lot on the bank - some would debit your account without warning (and leave themselves open to a massive complaint & settlement - not much comfort if you don't have a lot of money)

If it were me I'd keep the money in the account for a week or so, then move it (in small amounts) to another bank. If you're asked to repay it you've then got a decision to make as to how argumentative to be. Chances are they won't, but I'd give it 6 months or so as a bare minimum before contemplating spending it.

Someone is down £2,500. This is not a victimless mistake, and your mate is a churlish scrub who should be shunned by polite society.

Not necessarily. Natwest at least will show you an amount, but won't show the description for for a couple of days after. If this mate is in the same predicament, it might be nice to wait and see what the description says before jumping to conclusions.

If a payment is fraudulently or mistakenly
paid into your account, the amount of the
payment may subsequently be deducted. This
may happen even if the funds are included in the
balance of your account, you have used them to
make a payment, have transferred or withdrawn
all or part of them. If the deduction of the
payment from your account would either make
your account go overdrawn or go over an existing
overdraft limit, we will treat this as an informal
request for an overdraft

Quote from a banks T/C.
As you can see they do not need to gain your permission as they already have it.
Most banks would contact you anyway, but do not think that failing to answer/respond will stop the funds from being taken back. Even putting you over your limit, could see you paying charges if it can be proved that you moved the money when you knew it was not yours.
And don't think raising as complaint would see the money put back, as the FSO could back the bank up as it was the account holder fault for spending something that was not theirs.

Best bet is drop it in a saving acc and make a few p's on it.

????
As far as a bank is concerned any payment in or out is expected by the account holder untill told otherwise by the account holder....
Sure may trigger a security check if its a large money transfer.
But 2.5K is not large.... And the OP has not said how the payment was made.
