You came clean. It should be enough, especially if your past record is exemplary. I would try not to worry about it now, (there is sod all you can do about it anyway). If it goes against you, then ask for a review and ask your friend to come forward and say his piece.

I wouldn't know what the outcome might be, but losing your job over this small incident would seem bizarre, IMO. Thumbs Up

What evidence do they have against you?

CCTV? Does it have a date stamp? If not it is inadmissible as evidence even if you are caught fair and square.

And tbh the police probably won't give a damn.

AND FFS! Think about your future, i.e. don't just accept a caution as the end of it, as accepting a caution goes on your permanent record FOREVER and it can affect your right to work outside the EU.

To put it bluntly, if they want you out of the door, that's where you're going.

Theft is gross misconduct. Instant dismissal, no warnings etc. Click HERE and look at "threat to your employer" with respect their property. If you've stolen once, you could steal again, so they're allowed to escort you off the premises. You'd struggle to get an unfair dismissal case against them if that's how they want to play it. As far as evidence is concerned... You've admitted it now, that's all they need. Sucks doing the right thing eh!

I wouldn't think the police would be particularly interested in pursuing a theft case against you as they have real thieves to deal with, along with murderers, peaceful protestors, rapists and speeding motorists. Your employer can start a civil recovery case against you, but I doubt they would go to all that hassle over a couple of tinnies. If you want to be the bigger person, offer them the money for the property you allegedly stole and ask for a receipt. Then walk out with your head held high safe in the knowledge you don't have to work for a petty little jobsworth like them again!

It's a real shame you showed some emotion. I got the boot once for falsifying a stock report to improve performance after following the advice of a loss prevention officer (who I later found out was shagging one of my staff who wanted my job). Through both the initial interview and the disciplinary hearing I was stone cold poker faced. I knew they were giving me the boot, but didn't once show them I was bothered. Walked out of there knowing I wouldn't have to suffer answering to them ever again and I actually felt great. In fact, if I hadn't been sacked from there, I probably would've stayed in retail and ended up a miserable fat-bloke wearing a cheap burton's suit everyday of my life pretending that a decent job-title is worth working 20hours a week over my salaried income with no extra pay. As it happens, I'm a very happy (slightly pudgey) biker who's studying for a degree to get into my dream job. Couldn't have worked out better!

Are you seriously saying she's going to inform the police because two bottles of beer went missing, from a fridge to which numerous employees had access FFS? The police will tell her to piss off and stop wasting their time.
Did she take an inventory of the fridge contents?
Even if you did blurt out a confession, all you have to do is deny it, the conversation never took place!

If you have been formally accused of theft. You could insist that they do involve the Police whilst simaltaneously bringing a grievance for harassment. (check out ACAS, CIPD, Unions etc) Smile

Worst case scenario 'they' have accused you of theft, thereby making your position untenable.........so what do they intend to do to rectify the situation? Thumbs Up Thumbs Up

It does sound like they are being remarkably stupid or remarkably deluded.

I think the one positive is that you have at least learnt that honesty isn't always the best policy. Despite your naivety you did remove property that didn't belong to you and your manager appears to wish to use it against you on a personal power trip.

Go in, with a decent, adult, witness, verbally admit to being naive and misled by another employee and offer to pay for the missing items. Ball is in her court. If you seriously believe that you are going to be fired then hand in your notice. Legally (I believe) she cannot give a reference to any future employers that may detrimentally impinge their decision to employ you without sufficient evidence to back up the claims.

Next time balance up the pros and cons, stay quiet and do a bit of flagellation for penance when you get home or just drop a couple of quid in a charity box and let karma decide the natural order. Wink

We are talking about two bottles of beer here. Unless something is really messed up, I would think all there is to it is explaining that you thought it was the same as last year were people could take the left overs. Say it was a misunderstanding and pay for the two bottles of beer and that should be it all that there is to it.

I cannot really believe this counts as theft.

Just in case they get Plod involved, don't write anything down, don't admit to anything, or make any further statement and absolutely do not accept a caution. The CPS won't touch it with a bargepole, even if Plod do.

I presume you work in a bar of some kind?

For those who haven't worked in catering/hospitality it is a very big deal about even a couple of beers. Sure they don't cost much, but thats like saying it was only a couple of beers compared to a bottle of bubbly, like working in a bank and only taking the 50p coins not the 50 quid notes?

Evidently you thought because of a previous occasion you were allowed a beer or two after work. (Lets ignore the redbull/beer confusion) This should work in your favour, however there are always bar monkeys looking for a job, and there are always examples to be made of people, especially at this time of the year with new influx of student workers. Having the police come and take you away and give you a caution is a very good way of showing the other workers that as an employer, stealing is not ok.

I think also, it is entirely possible that your honesty put them in a bad position. They could well have been giving a talk to the whole staff to make people think twice before grabbing a beer, fully expecting noone to own up and say it, and because you did own up, they feel obliged to do something about it.

No i work for a clothing company. Its been blown out of proportion mega style.

Went in this morning and talked straight to my manager who accused me yesterday. I asked what exactly i had done wrong, if i was being diciplined for theft etc. Would the police be involved. She totally danced around the subject, not giving me any explanation other than she was going to take it further later on today. Actually got arsey with me, and made me feel very uncomfortable. So i said i cant work under the conditions and walked out.

Have phoned head office and talking to them later today. Im not the first employee she has treated like this, and for her to say im a thief is totally unacceptable. I think if you try to imagine red bull cans and beer bottles laying together in a fridge, with people freely taking, you will see my point. Like i said, it was fine last year, as they ARE leftovers from an event. And as an employee, it is seen as a perk. This year i made a mistake because i just didnt know beer was THAT different to red bull. I have no criminal history, nothing. So for her to say those things, etc. Uh. Demoralising, didnt sleep last night.

I said i understood it was wrong, and offered to pay for the beer, but i wont be treated that way by my manager.

Guess ill update in the future, i really appreciate the responses. Has helped alot. Thumbs Up Karma

Quick update;

Back at work now. Got a warning for not taking stuff without permission ( Confused ), and can appeal against the decision.
Stays on my record for 6 months, but to be honest i dont understand why i have been given it. Part of me wants to appeal, part of me wants to forget the whole thing. Cant see myself being there after xmas. But then you never know. Confused

At the end of the day it was a stressfull two weeks and i would rather see the back of it. Plus side, i succesefully vented how i felt about my manager, and now everything seems normal. Rolling Eyes

Odd one. But again BCF.. any thoughts?

They still can''t sack you off a single (oral?) warning, still need a written warning, final warnings of some sort then a hearing where you can be represented and anything else the company will include in its dismissal procedure. It's very difficult to out-right sack someone.

If they don't follow that they'll be in breach of contract and you can take them to an Employment Tribunal for wrongful dismissal. (So many companies dismiss people fairly but they don't follow the correct procedure and find themselves paying you out for several weeks work while you were sat at home looking for a new job). Laughing

Best to just keep quiet though... As you not been sacked yet! Very Happy
The punishment cannot be higher if you appeal it, but might be better to let sleeping dogs lay.
