I had an accident a few months ago whilst trying to bumpstart my bike and i wasnt wearing my lid so when the bike started i rode back up my street and pulled out from failing to see a car coming down the street wich was hidden by a parked van,and i collided with the car wich resulted in writing of my poor yamaha dt 125 x and denting the blokes car and when the police came becuase i wasnt wearing a lid they ended up charging me with...Riding without due care and attention.contrary to section 3 of the road traffic act 1988 and schedule 2 to the road traffic offenders act 1988....they also charged me with regulation 4 of the road traffic act 1988,section 16 (4) protective headgear act 1988...so my foolish mistake was a big downfall in my life Sad but hey atleast i have a new bike and still hold a licence Thumbs Up

You don't get points for not wearing a helmet though. It's just a fixed penalty fine of £30 as far as I'm aware.

So the rest was for driving without due care.

Correct,stinkwheel the most of the fine was to do with the, without due care and attention,wich carries the points..where as the (protective helmets) act 1988,i was charged a 60 quid fine for that.

I really should of went with the sikh idea Thumbs Up if only sombody had come up with that when i had the crash i well would of tryed to use that as a excuse Thumbs Up Laughing

The compulsary Crash Helmet law dates back to 1972, before most of you were even born... even I, who you all believe to be as old as an american red-wood, was barely even old enough to toddle!

I have a feeling that the Compulsary Helmet law actually pre-dates the Race Relations act by a couple of years!

It is a curiouse exemption, though. The wearing of a Turban is not strictkly 'compulsary' even for a devout Seik, it is merely requires as a sign of 'due humility before god', to have thier hair covered in public; what they use is entirely optional. It is one of the holy symbols, which if I recall correctly, Seihk men, are 'permitted' to wear as a display of thier affiliation to the teachings of Guru Nanak... Or something like that...

If I recall the history; the exemption was made on reading, and there was a lot of debate as to whether making the wearing of a helmet compulsay would conflict with existing UK religiouse laws, I think the "bill of tolerance" that pre-dated the Race Relations act by I think a few centuries! and the whole issue was brought about by MAG, significantly of white, anglo-saxon ancestry, for the most part, looking for anything and anything to lever against the bill, in the bid to get it chucked out entirely! I think they had ONE Seihk lawyer, present the case, and later shown he didn't even have a motorcycle licence!

It was probably allowed on the basis that there were very few Seihks in the country at the time, fewer still riding motorbikes, and even LESS that might actually be 'devout', so it probably wasn't worth arguing over.

I have 'knowingly' met only a few Seihk motorcyclists in this country; all of whome have volunterily elected to wear a lid. I have seen I think two or three people ultilising the Seihk Exemption. One regularly rode a Cagiva Planet around Fosehill, in full Seihk turban. Another, a middle aged gent, who rode an Indian built Lambretta, around Coventry, and a young As-Chav who had I think a Two-Stroke Derbi 125 Dirt-Bike, who I encountered heading back into Fosehill on my way home from work each evening, who wore only the 'knotted hankie' of an unconfirmed Seihk, and who rode like a loon!

(There is a big difference BTW between Seihk Turban and Moslem Turban, and like cuts of tweed, they have a language devoted to the different styles of turban, AND the many, MANY ways that they can be folded to wear.... you think a 'Windsor' knot in your school tie is complicated! The 'Devout' Seihk Turban takes about forty five minutes JUST to fold and put on! It was demonstrated to me once, and all the symbolism and seromony explained.... unfortunatley in Punjabi, translated by the blokes son, who sort of paraphrased it.... "He folds it like that for God!")

there is no way the police charged you with "driving without due care" for riding without your lid. im more inclined to think they charged you with "driving without due care" because you were messing about and hit a car, and due to the fact, you wrote your bike off... im sure you wasnt sticking to the speed limit.

the other post is right, not wearing a helmet is not endorsable, just fine, but they cant take your bike off you if you dont have one while riding, so be warned.

If you did not speed or do anything wrong and its was just an accident then your result was too harsh and you should have contested it at court. driving without due care isnt just given out for no reason.....

To be honest the fact that i went round a parked van at about 20mph and the car was also traveling at roughly 15 to 20 mph towards me makes no surprise to me at all why it wrote the bike off although i really thought long and hard about getting a legal aid but it was my fault, plus i was foolish to ride like a helmet with out a helmet and i didnt want to piss them off (ie) the (crown prosacution service) so i decided against legal aid plus i cant afford it anyway and i would of have to of paid becuase i earn money unlike the scum of society Neutral who ride dirt bikes around the streets and all they get is a section 59. where as i actully had insurance tax mot and a licence at the time and i get a arse raping for a stupid mistake its just sods law really.

ps. im regretting not paying for up legal aid Thumbs Up

But atleast i still hold some shread of a licence!
