Hi there,

as some of you know I was hit by a car a week into my insurance, which lead to the third party claimining whip lash on my insurance(3/4 people).

The collision, wasnt that bad for the car, but I suffered injuries.

I was going 8-10mph, he was going 3-4mph when he swereved into my path.

he also pulled up fake witnesses /facepalm.


anyway...

When trying to get car insurance quotes, im either getting rejected or being asked to pay a shit load, because the case is still in dispute.

I cant cancel my bike policy, because there is a claim.

I cant upgrade my 125 to a 600cc without taking out a new policy.

What do you guys suggest for me?

More to the point. What the hell are your insurance doing even entertaining a claim for whiplash after a collision between a 125 and a car?

So you hit a car with a speed difference of 5mph on a 125 and they are trying to claim for whiplash...


I am surprised they even noticed it.

Was the car even damaged beyond the bumper?

Not a very good insurance company.
You should be claiming for your damaged bike & injuries, was the incident reported to the police ??
Statements taken at the time ??
Road accidents involving injury must be reported as far as I'm aware so what does the police report say ??

this country really has gone for a shit. Cant stand this compensation culture.
Insurance is just getting more and more expensive for the decent honest people which just sucks balls.
The most frustrating bit is there is nothing we can do about it Confused

My insurance was claimed against when I was on a 125 and went into the back of some woman for whiplash.

£5000 or so.

I have a solicitor, the accident was in small heath birmingham...

my solicitors are arranging a doctor visit for me.

I've told them about the witnesses being fake, as none of them were at the scene.

I've yet to tell them how the whiplash claims are fraudlent and being using as means of profit.

wont forget to comment how "small heath birmingham is always on TV, with people doing insurance scams etcetc"

Well, if you've been stitched up, you've been stitched up. However, it's got to be worthwhile contacting the cager's insurers or solicitors directly and saying (feel free to be frank) that since their clients are lying toerags who doubtless have a history of dodgy claims or other offences of deception, that they can stop nobbing around right now and make at least an interim payout.

T.C. might be able to advise, but personally I'd be inclined to tell the solicitors and insurers to all do one and get it before a court so that it gets sorted out one way or the other.

Yep, should probably do that..

this is the first time ive been involved in a legal case like this though, and Im 19 years old so I have no idea how it works.

Just left a message for my solicitor..basically said 'hope your not even considering their claims against me, i believe of them to be fraudlent and a means of profit, considering i was the biker, and they were in a vehicle.'

Hopefully she'll get back to me when shes back in office ¬.¬

This has been going on since June ;o..such a long process :@

I have my court date set in December for when some dozy bint crashed into me at a roundabout over a year and a half ago. She decided to sue so I had to counter sue. Bet it goes knock for knock. Anwho, the points I was going to make were:

    It will take longer than you ever imagined.

    It won't be worth whatever the payout is to either party once compared to the time waisted and the grief caused.

    Insurance will rape you.


I managed to insure my car for another year after the incident but this renewal I couldn't afford it and the bike so declared the car SORN and put it on a friends private road for now. Even though the incident happened to me in a car I have to declare it on my insurance for the bike and as it isn't settled yet it has to go down as a fault claim apparently. Frikkin huge insurance quotes. Evil or Very Mad

Hope your solicitor team are better/quicker than mine!

How the hell do you get whiplash from hitting something on the front offside of the car, unless you hit a wall?!

Plus that car looks like it has been detailed - who treats a bog standard Honda Civic like that?

the red marking on his wing is off my leather bottoms Sad

basically, as i was going past.. he swerved his car and knocked me off to the right..

This is why i'm sitting considering using a camera on my commutes. No real witnesses mean that he could have said a tidal wave came up and swept you into his path and it would still be 50/50.

Bike/Car insurance is a really nasty thing to deal with.

shit like this really fucks me off, in life shit happens few knocks yada yada, the world is full on moaning weak people, and unfortunalty these people seem to drown out the real people that need help and compensation due to life changing injurys not just a bit of neck ache

Currently have the dodgiest crash of all time trying to claim for whiplash because my indicator hit the side of their car. Didn't get any photos and they have already argued the toss on getting the panel replaced on their car. If you haven't got any camera evidence and they have more witnesses than you, you can apparently get but raped for anything.

I am however convinced these guys are the same guys that stole my bike the following week and are an experienced bunch of thieving scamming wankers. Remarkable coincidence that a bike thats completely hidden from view from the road and path goes walk abouts the week after I exchange insurance details with a bunch of scammers...
