After my crash earlyer this month the bike was taken away for inspection by the third partys insurance company, yesterday they tryed to offer me £4500 for the bike but after proving that it was worth at lest £5500 (mint ones sell for £6000-6500) l have got them to agree to this but before the bike was taken l made it clear that l wanted to buy the bike back as salavage but the insurance company have told me that the £5500 offer was condtional that l buy the bike back for 30% of its value which is £1650 but due to the heavy damage the bike took its no way worth £1650 which would leave me with £3850.

They are now saying that because l said l wanted to buy the bike back over the phone and l said that l was happy if the bike was valued at £5500 l have to accept there offer of £3850 and the cheque for that amount is in the post.

Any ideas what to do l,ll rather not have the bike and just a cheque for £5500

It isnt 'accepted' until you cash it anyway.

Ring them and tell them you valued the salvage to be much lower than their estimate and as such are declining the part payment and expect the full value cheque as replacement.

Is this a serious question?

Well, you were a bit of a muppet by appearing too keen to buy back the remains, but it doesn't sound like you've entered into an agreement to do so at that price.

So get back on to them and tell them to stop having a laugh unless they want to end up before the Financial Ombudsman or a County Court.

Keep it short and clear. You reject their offer. You expect the full value of the bike, and what they do with the remains is up to them.

Get it done, no messing around, and kick off a complaint against them (through their own complaint department initially) for good measure.

Apparently there is nothing in place at Churchill whereby claimants are expected to retain salvage. It is an option, not an expectation.

Just treat it as haggling, they have made an offer and now you can decline it.

Demand the 5500 value, they agreed to it.

They are trying it on, done it with me many many times Laughing Although I've never asked to buy the bikes back.

This Bandit was bought back for £265 - 10% of the agreed value. It was only lightly damaged - bent forks, bars, couple of busted indicators, few scratches and a dent in the silencer.

30% for salvage is taking a liberty - offer them 10% or shove it.
