As many of you probably know by know i had a fail, ended up arguing with a wall Embarassed . Still don't remember what happened, i've been having nightmares about it. Same thing happens everytime, go round a bend then the back wheel locks up for no reason. I try my best to control it but end up hitting the wall then wake up.
Managed to break 2 ribs, pop both lungs, damage my kidney and spleen, broke my face around the eye socket, snapped both bones in my wrist and knakered a ligament in my wrist. Was originally told I had 2 fractures in my back, went for a check up Monday.
The consultant that did my check up discovered there was actually 5 fractures, not just 2. He sent me for an x-ray, this showed there was only 2 fractures that haven't healed and possibly one that hasn't quite healed. He said I should of had surgery but because it's healed so well upto now that i shouldn't need it any more. Also discovered that i may have scoliosis, but it's hard to safely say because my wonky spine could have been caused by the impact. Good news is my back shouldn't stop me working as long as i dont lift anything heavy.
Got to go hospital again Monday. X ray then if my wrist has healed i'll be having the cast off and the all clear to work. If not then it's back to have my wrist operated on again and have the bone rebroke and the metal plates put back in position.

That was my black eye after just over a week, apparntly when i was on life support it was bigger than my nose Laughing .

Police released my bike today. This is how it looks.

It's a lot better than I expected. Needs new forks, yokes and a front wheel to get it riding again. To get it road legal on the other hand might need a bit more lol.
Quite surprised it still turns over and attempted to fire. Might of helped if i put the tank on lol. The clip ons aren't bent just need re-setting, tank isn't dented just needs some paint. And to me the frame looks straight.

I should be getting my skid lid and what not back tomorrow off the police. i'm going to try and get copies of my x-rays and scans on Monday too.

Not sure if serious Thinking

They took tank and seat off too. It would appear they couldnt be arsed to put it back together properly. The tank nd seat fell off putting it in the van.

Well the police man dealing with the investigation has just been.
No point putting up pictures of the gear. Besides the cuts the paramedics made in my jacket to get me out of it you can't tell i crashed in it. And the helmet looks perfectly fine, visor has broke.
I was expecting the helmet to have a big dent in it on my left where i broke my face, i was told the front of the helmet was smashed up. So I'm not quite sure how i managed to break my face.
The careless driving is not for the accident but my riding style before the accident. Apparntley there's a witness that say's i was overtaking on double white and doind exssive speeds. So why the lad that was with me isn't getting prosecuted i don't know. Then there's driving not in terms to my licence. He's not heard from the insurance to wether i would still be covered. Although he believes i should be, in cases similar he said the insurance normally still covers the rider third party only but doesn't cover for any losses to the rider. (not like i'm claiming anyway). He thinks that i'll be looking at 6 points if my insurance say they would still cover me.
But he also thinks that it'll be bye bye licence Sad . He wasn't 100% sure but he thinks the new drivers act still applies to me. Even though i passed my tractor test well over two years ago. Not sure wether this is the case or not because i have code 118 by my tractor entitlement. According to the goverments website 118 means - start date is for earliest entitlement
https://www.direct.gov.uk/en/Motoring/DriverLicensing/WhatCanYouDriveAndYourObligations/DG_10022623
And it doesn't mention on the new drivers act if the tractor test does apply to it or not.
https://www.direct.gov.uk/en/Motoring/LearnerAndNewDrivers/NewlyQualifiedDrivers/DG_4022566
It does say that it only applies from when you passed your first test, s by rights the tractor test should get me out of it. But i'm still preparing myself for loosing my licence, it's looking like i'll have to change career. Think I'll go and get shot at if that happens.

Sorry to hear that chap.

Others will hopefully heed this as a warning that people do still get caught for riding without a restriction.

Might want to get that frame jigged just to be sure it's straight, would suck to spend money fixing it to find out it's a bit wonky. It did take a serious impact judging by the state of the yokes Shocked

I'm not fixing it up even though i could street fighter it, without too much trouble. It's the second cbr to try and kill me, even if the 125 was my own stupidity. I'm not risking another, 3rd time lucky n all that Laughing .
when i have my right hand back it'll be getting stripped sold as spares on ebay, what ever doesn't sell will be weighed in.

That's sucks woll, when I had my accident on the drz they did me for careless driving (over taking on a junction) but Thames valley police gave me the option of the RiDe course which if you complete it, will mean you don't receive the points.

Worth asking if your constabulary offer the same course!

I was 19 and still on restricted lincense, but they never took the bike to check - I would imagine they would only check if there was serious injurys

Because one random says you were riding dangerous you will get 6 points? I can't see that somehow. I'd take it to court.

From what pc pold told me it'll be goin to court anyway. I doubt they can get one persons word to stick. It's his word v min and my mates word. Plus the fact that everybody has a different perception of speed, I doubt him saying we were doing "excessive speeds" will stick.
Personally i want to get back on bikes, just not a cbr Laughing, mother has told me im not allowed another while i'n under her roof Rolling Eyes

Got the cast off on monday Very Happy got to have physio now though, i can't move my wrist barely.

Careless driving carries 3-9 penalty points, I've faced it before, but when it got to court it was presented at Dangerous driving.
I had it dismissed, but I was disqualified under the judges discretion anyway. Mad

My point is, seeing as how you've come off in this incident anyway then you may have some bargaining for a lesser penalty if something like a rider improvement scheme isn't on offer.
So if you can't successfully argue it, which I don't see as being a problem against one witness...
Plead to their compassionate side (which I'm not sure is actually there, but you can imagine they have one if it helps Razz)
and they may well see that you've already lost out big time for your 'crime' and decide to lessen the blow with say only 3 points.

Driving otherwise than in accordance with a License carries 3-6, so again hope that they pass the lesser punishment, I don't see how you're going to argue this one.

I for one was perfectly aware of this when I rode un-restricted, not a biggy in my eyes and I was challenged for it once..
I blagged the copper that the bike was restricted by a device in the clocks ala the Japanese 112mph restriction (A), which amounted to the same thing (B).
Point A was technically true, well until I removed the restriction that is... Point B was just a lie.

Mostly, regarding license and insurance issues, you can play by your own rules until you have a crash..
and I work with the reckoning that if I have a crash it will be big enough that such trivialities will be the least of my worries.
Not advice to be taken, just the way I have personally looked at it. Thumbs Up

Cheers,
Mac.
