Who was crossing who's path? Even with no lines, you still have to make sure you don't do anything to cause another road user to change speed or direction - it's an instant fail in the test.

Marks aren't great but they couldn't be really mistaken for anything but give way lines. The rain won't have helped visibility but they are still there.

Bummer, glad you weren't badly hurt. How did the Merc driver deal with it?

Well, they're pretty clear in the photo. Plus a main road running perpendicular to the road coming out of gives a clue that might have to stop.

Not having a go but I think this time you're lucky you weren't creamed by a lorry.

from the Third & forth pic I'd say you crossed a give way and the Merc had right of way as
I don't see any lines where he came through, though pic 4 right at the merc's ass
looks like there may have been lines that have been removed

Looks more like a surface repair from an old trench that's been dug up the road.

Sorry chap, but it looks as though there are give way markings there and you missed them. I assume he was coming from your left ? In which case he definitely had right of way and you pulled out from a feeder road onto the main road in front of him.

The lines are clearly there, even if the werent its still clear the road was leading onto another, despite diversions or anything else you should have been checking for traffic before entering the road, the merc had right of way unfortunately.
Hope that doesnt come across harsh as its not intended to be.

Sorry mate, looks like you had two warnings.

First is the single broken line that tells you you're moving into a junction, second is the double broken line that tells you to give way.

If you wanted to get picky, you could try taking the local highway maintainance department to court, for failing to correctly maintain the markings, but I suspect that in that way lies madness and a large amount of expense, with little chance of getting it back.

Seems pretty clear to me in the pics, so better obs required, I'm afraid.

This exactly well apart from taking highway maintenance to court you will be waiting a minimum of 4 years, that's how long I've been waiting so far.

Better obs next time you take a junction like that I would slow right down when you are coming to the merc road, this covers you one for the conditions and two for braking distance.

Was there any other witnesses there that vouched for either you or the merc driver, if you do try and contest it that will be your first hurdle id guess.

For future reference, try not to look at the thing you are going to hit, or will drive straight at it. Look at the place you could steer to where you would not hit the object, and you will find you may be able to avoid it. It's easy to say, but quite difficult to do in reality!
