I was in a small queue of traffic waiting to set off and as the car started moving off in front I got hit from behind by another car (which was stationary before moving off and speed on collision was roughly 5mph) before I could set off , I pulled over and exchanged details and he has since called since I got in to see if everything is okay.

I was taking the bike in tomorrow for a new rear tyre, chain & sprockets tomorrow, so I will ask if there is any damage which needs repairing or any new parts (which the guy has said he will pay for), the guy has admitted blame and my friend was there with me to act as a witness. My number plate bracket has cracked and a piece has fallen off, as this is my first 'crash' I have a few questions:

A) Is the cracked number plate bracket a problem & does it need to be repaired.
B) Do I check he will pay for the repair or new parts(if there is any), or do I get them done straight away and if he refuses to pay make an insurance claim.
C) I have a slight pain down my upper back, it is very slight and I don't want to go down any personal injury claims unless I have know other choice due to the 'crash' causing any real damage.

All I want is for the bike to be how it was before the 'crash' and won't be taking anybody for a ride or trying to cash in at all. Any advice or tips appreciated thanks.

ANYTHING that was broken/cracked/damaged should be replaced.

Get a quote for all the parts etc then pass it to him, if he is honest he will then give you the cash for the work to be done.

Do not pay for anything yourself then ask himn to pay you back. It wont happen!

You can do either of two things:
Do it all through insurance.
Take it to a garage you trust and ask for estimate to repair.
If the third party agrees to pay for the damage its it settled when he agrees to pay. Get this in writing though.
It may be a case of you pay and then get the money off him.
Whatever you do....

If you tell your insurers it counts as a CLAIM. Whether blame or not it is a claim.
In any event you must recover your UNINSURED loss from the other party through your insurers to have a NO CLAIM status.

Some insurers are funny though and can load future policies just cause you made a claim.

Find out how much to repair 1st and speak to the other driver is what I'd do.
If he refuses to play ball then report it to the police and then your insurer. Or do small claims.
Citizens Advice can help too.

Bitter Bitter experience has taught me one thing : tell your insurance company straight away if you are going to make a claim!

Many moons ago Someone damaged my car and then told me that they would pay for it, so far so good.
Because of this I did`nt notify my insurance company, (doh!)
A few days later they called me and told me that they would not be paying for any damage.
It turned out that he had given me his uncle`s insurance details and refused to confirm he was even there at the time.

Two years later and after a very slow police investigation, I got half the price of the cost to fix the car and as far as I know via a second hand conversation with a police officer he got three points Twisted Evil .

These days if I`m involved in an RTA and as long as I`m not all broken, I will take thier keys off them until the old bill arrive, even if I have to use violence (allegedly)

I agree that his recollection of the event is likely to change as time passes and the bills rack up. If there's any chance of taking it further, write down and photograph everything right now.

Price the number plate bracket and decide how much hassle it's worth. Personally I'd probably just shrug it off and fix the bike myself, particularly if the driver had tried to do the right thing, but I'm pretty flush.

If you're going to ask him to pay, ask first, and offer him the opportunity to find a cheaper method to make your bike good.

If you have back pain get it checked out. Not just for claims purposes, you could be inflaming a spinal injury. GP, or if you get no joy, straight to A&E and over-state the damage and pain as necessary to get taken seriously. Don't worry, you'll just be skipping ahead of some pissheadwith with idiot rash or a health tourist.

Looks like you were injured, so you need to report it to the police anyway within 24 hours.

If it just is the number plate bracket, I'm thinking of just leaving it as he has seemed to try and be nice about the whole thing, would this be a bad idea or does it need fixing?

How badly is it broken? If it's holding the number plate on securely, job's a good 'un. If your plate itself is broken, you're looking at about £6 or £7 from eBay. Pics would help.

It's a long plate holder and the piece missing is 2cm X 10cm hardly notice it's missing.
