PostPosted: 20:52 - 12 Dec 2011    Post subject: someone just knocked my bike over now denying it Reply with quote

About 20 mins ago I saw my bike go over outside, looking out the window and its on the floor with a mini convertible next to it, a woman across the road informs her that I have seen her from the window. Unfortunately I was on my own with my baby daughter so by the time I got her dressed for the cold and got outside the witness had left and over the next two minutes the mini womans story changed from i'm so sorry I didn't see it to I don't think I touched it in fact. When I asked for her details she denied hitting it and went back to her car. The bike was already damaged on the other side from hitting the deck on diesel a couple of weeks ago but now the lhs footrest hanger is snapped and the fairing is fucked. Recommendations of how to proceed please ( I have her numberplate)
thanks
Rob

If you're going to make a claim against her (or just reporting to the Police), the number plate and vehicle description is more than enough to identify the registered keeper - and your opposite neighbour being an eye witness is in your favour... Thumbs Up

The only thing that i can suggest is, goto the police with the number plate and make a formal complaint and ask them to investigate. Without witnesses to the incident, it's not looking good, unless you can swear that she admitted guilt. Let us know how you get on.

File a report with the police, perhaps a threat of leaving the scene of an accident will be enough to make her 'fess up. Hopefully she has some scratches on her car that will tally up with something pointy on your bike.

Counts as 'hit and run' i think. if you have reg then call police and tell them you saw it and the person refused to give details and left. don't mention denying or admitting just say it was refusal. call insurance once you have a crime number and just keep on at it until someone caves. seen it done when a guy i know dropped his and mashed it. he rang around saying sum1 hit it and he didn't get chance to get details and since there was no cctv to prove him wrong they payed out. in your case it actually did happen so as long as your insured it should work out. if all else fails then Chinese water torture will get you what you want Smile
good luck.

What? She tried to run you down, you say! Shocked

Dial 999! You got most of her number plate and a clear view of her face, if they're quick they might catch her!

She started it.

Seriously why didn't you take some photos instantly?

It should weigh in as more evidence against them. I keep in the glove box of me Yaris a disposible camera should anything bad happen to me.

I know photos should have been taken immediately but I was trying to calm my daughter who started crying the second I shouted out the window whilst trying to work out the quickest way to get downstairs and sort things etc, I have a photo of her parked 2 foot off the kerb engine running in the disabled bay next to the bike bay where my bike was the only one there

This. You were watching, wondering why she was so close and then you saw her knock it over.

It never even occurred to me that the OP might not have "seen" it happen. But yes, honesty is what you apply when dealing with the honest. Embarassed

Knocked on doors to see if you can find the witness? It'll be a big factor in your favour if she can even just confirm the type and colour of car.
