So basically, my little brother is a tool and went and got an iPhone 4S through the carphonewarehouse. 24 month contract, £50 a month including insurance! That's along with paying £100 for the handset. Totally shit contract for his needs, far too expensive basically. We went back to return it today and apparently Orange don't let you cancel the contract after 14 days like I assumed... so we only managed to cancel the handset insurance which brings it to £36 p/m. Does anyone know a way out of it? The next plan of action was to phone Orange and say, look, I can't afford it etc. and see if that helped. He can afford it, but the contract is too long and the 4S is barely any different to the 4, so not worth the extra cash if you ask me. I didn't realise phone contracts were such a pain, I thought they all had the 14 day cooling down period but apparently only o2 do it. In summary, the kid is an idiot and shouldn't be allowed to sign any contract so I'm trying to fix the situation and save him money.

He's just turned 20, and yes, he is not very bright and that's me being nice, but it's done now and I want to try and sort it out if possible.

Please tell me that he wasn't daft enough to give them his credit card details?

If it's on a direct debit, I'd cancel the DD, put the phone on the counter with a note instructing them that the contract is void, then walk out of the shop. Wait for the debt collection agency to start their threats (at least they can't call him Thumbs Up) tell them to sling their hook as it's under dispute with the alleged creditor, and then forget about it.

I wouldn't worry about his credit rating getting hosed, it's unlikely to be the last daft thing he does.

If he were my brother I would be inclined to let him continue with the long and far too expensive contract so that he could (hopefully) learn a lesson from it. But then again, I am a bit of a bitch. Your brothers brand new must-have gadget was going to cost him £1300, now you got rid of the inflated insurance its going to cost him £964. Ouch!

Have you tried putting in a complaint with Carphonewarehouse? They have mis-sold a contract for your brother that clearly does not fit his needs. As its after the 14 day period I doubt you will get very far chasing this one up, leaving a contract before it has run its course will cost you.

Yeah we went today and the manage basically said "it's not our problem whether or not the customer can afford the contract". I was thinking contacting Orange directly with the mis-sold contract thing would be best. He is not great with money, he's one of those people that have to learn everything the hard way and his gf is not much better... too interested in the now and don't care about the future.

He doesn't have a CC thank fook Shocked leaving it on the counter would be no good as he paid £100 up front for the handset etc.

I was thinking, he could have bought a brand new iPhone 4S for £500, then used GiffGaff for 2 years on the £10 rolling contract and it would be £740 as opposed to £960... he just doesn't think like that though. Yes iPhones are expensive beasts but if you shop about they aren't that bad at all.

I have been with Orange for 10 years or so and in my experience have always found them to be helpful, I know that some people on here have a completely different view of them! Its worth a shot, especially if you make a big deal about how your brother was talked into the contract that doesn't meet his needs. Maybe offer a compromise?

Lodge a complaint with CPW too, go official and put it in writing.

I am wondering what exactly he gets for £100 handset AND £36p/m?

(I am aware of Apple's overpriced marketing cr@p.)

But what mins/calls/inter does he get?

I'm £23p/m with Unltexts/300mins/500mb with free (new at the time) handset.

He's clearly been shafted, and was a retard about it, but you already know this. Officially there's nothing he can do. He's out in the big world now signing contracts. Maybe you should explain to him what exactly a contract is before a worse situation appears.

But IMO he'll have to take it as a lesson learned, as pretty much the only thing he can do is argue he was mis-sold it or pressured into it, but even then I can't imagine Orange will give a fcuk. Neutral

Out of interest did he come to you with this saying he's made a mistake? Or did you get p!ssed with him when you found out and make him fight it?

I believe it's 300 minutes/2000 (or 3000) texts/1gig internet. GiffGiff would be 250 minutes and unlimited texts and internet.

I only found out he had the contract a day after when he started asking me about apps... then I went over his contract and was like WTF Shocked Shocked Shocked He thought it was £34 + £8 p/m at first which shows he clearly did not read the contract at the time. For that reason I think I will just not bother helping him. He obviously just walked in the nearest phone and shop and said "giz an iPhone, yeah he's my card" Laughing

For £50 a month i got a 32gb 4s, unlimited internet and texts and 1200 minutes

But yes, Retard much like myself.

I used to do this sort of stunt when i was his age. I had an almost mobile phone in 1990 that was something stupid like a quid a minute chargable from the second you pressed the call button.

Well, if he got a contract recently with the recent higher prices then no.
However, I am on Orange and they have set an increase in their line rental. Even though by the terms and conditions, they can legally up the rate as long as it is under the inflation, you still have a way out.

Send a letter to them that it affects you too much and your life will be ruined. Also contact of com. I forgot the wording my friend said but you need to explain that the changes in price are detrimental to your living. All the phone companies signed to this and if anyone has this issue if they increase their prices within a contract, you can use it.
