My work mate who passed his test same time as me and goes same route to work has been busted 67 in a 50. He got his driving licence 2 years ago march time and passed his bike licence in the summer.

I say he is looking at a ban but he reckons 3 points and a fine.

I know where he got caught too because the police regularly put a van in the same place and it's easy to spot a long way off.

He is sat here now with the letter and it says at the bottom "under section 172 of the road traffic act 1988 you are required to supply the information required above within 28 days beginning with the date of service. failure to supply the details required carries on conviction, a penalty of up to £1000 fine plus 6 penalty points"

I believe that to mean the 6 points and the £1000 fine is what he gets if he doesnt give the info regardless.

I have never been done for speeding before so never seen one of these letters, I thought BCF would be the best place to come for answers.

Ban or not?

what he's received is a notice of intended prosecution (NIP) when a car/bike is caught speeding this is sent to the registered owner of that vehicle who is then legally required to disclose who was driving/riding the vehicle at the time, if they fail to do so within 28 days then the registered owner will receive 6 points and a fine. once the registered keeper supplies the rider/drivers details then if it's not the registered keeper the relevant person will receive the NIP. as for what your mate will get probably not a ban id of though 6 points is more likely

Don't your local constabulary offer a speed awareness course instead of points and a fine? My niece was had on camera last year and had to go on a one day course. She never heard anything more about it.

My mate said anything other than a ban he can live with so points and a fine would be good.

The speed awareness course mentioned, my dad went on 1 a month ago which i was surprised about as he has been very lucky not to get banned before.

Speed awareness is only a 2hr class briefing to help you become aware of what speed means. Some forces have a more prolonged practical section too.
It also depends on how much over the limit you were going. It is only offered to those 'slightly' over.
The guideline police will use is:
10% over the limit +1mph
so for a 50mph limit therefore 50MPH+10%+1MPH=56MPH

It costs more than a ticket, but you save on premiums later (if you get another ticket)
It is only offered to you if the police region have that campaign running.
If you have been on the course within three years of your latest offence it will not be offered. You will be taken out the back, hit over the head with a heavy stick, buried in the grounds with a shovel of lime scattered over your soggy remains.

3 points and a fixed penalty.

Tell him to supply his details and see what the offer him. If it's 3 points and a FPN, likely take it. If it's more, tell them to prosecute and demand to see the evidence, if any.

I did the speeding awareness day for same price as a ticket but no points.

Mine was 75 in a 60mph zone so a simular margin.

Another guy there was there for 92 in a 70, thats 22mph over the limit, so your friend will be ok.

Got 3 points and a 60 FPN for 56 in a 30 ( much nearer 100% over the limit) and the guy said if i hadn't slowed down (he said i was doing 60 when he first gunned me, and I was) i'd have been straight to court.

I doubt he'll get a speed-awareness for that, but a fixed penalty is quite likely.

I'd be very surprised at a ban.

I got pulled for 58 in a 30, and got 3 points and a £60 fine.

In fact that's a lie, I got my licence back with no points and a refund of the money, as they decided to be 'lenient', no idea what happened but I'm not complaining. The bike was actually 2 months late for it's MOT, he even checked insurance and what not on PNC, think it was just my lucky day.

I got done for 36 in a 30 - I took the wrap, but was uber pissed that the car in front, who was also doing the same speed, and was my girlfriend at the time got let off Laughing
I did the course and found it to be informative to be honest.
