Hmmm...

I didn't declare a claim against me from recent car driving history. Insurance now want to add additional premium for this. Fair enough I guess, was a genuine oversight on my part, I will pay up. This being the case then why do they not take into account my six year NCB on the car (had NCB protection).

Ok, so I'll find another policy becasue I feel that I am paying far too much now. How much will they refund if I cancel this policy? From an annual premium of over £400 I will only receive £100 back!!! I only took this out in November. Deductions for cancellation fees and other utter b*llshit charges.

I guess life isn't fair but this just seems too much of a rip-off.

All words of comfort appreciated.

Is your car still insured? If so, you couldn't 'use' it anyway.

You will find some companies will actually take account of other no claims bonus.

It's up to you to choose the ones that have the conditions you like - nobody forced you to buy insurance from this company, you chose to.

Questionable cancalation fees are the norm for the industry - but it's also quite possible that they may reflect reality - that it costs them pretty much the same to insure a car for 9 months as 12 months.

You would have had a full run-down on the terms and conditions of both the insurer and broker (if applicable) at the time of taking out the policy and a whole 14 days cooling off period to walk away from the contract if it didn't suit you having read it. Presumably, you didn't read it?

Anyway, at any rate ICOB7 of the FSA handbook states clearly that:
The amount payable must not:
(a) exceed an amount which is in proportion to the extent of the service already provided in comparison with the full coverage of the contract; and
(b) in any case be such that it could be construed as a penalty.

It does also state that the firm can charge you if you've been clearly notified of the charges, but (b) above overrules that in respect that the firm must prove that the charges made are reasonable - I don't think anyone could consider the deduction of 3/4 of the policy premium for 1-2 months cover being reasonable.

Yep fair points all round thanks all.

G - correct, no one forced me to take out this policy, just a general rant really on the inequity of insurance policies in this day and age. Thanks anyway.

Feel your pain mate. AS said, at least they didnt cancel your policy, because believe me, that screw you.

You think your insurance is over inflated? Try being 25, 9 points of which 3 were serious, Had insurance cancelled previously, and a criminal record to boot. Now that is not fun.....

But fuck it, you make your mistakes, learn your lessons and pay the price!

Yep, was recorded on a database somewhere.

I genuinely assumed I did not need to declare as the manner in which the question was posed in the online form. It asked about claims against the 'rider' which led me to assume that car related claims were not required. Wishful thinking as ever.

I'm glad I read this thread! I was going about getting insurance quotes for when mine's due in April, and I wanted to put my Dad on the policy this time too. We both thought we didn't have to declare car claims Thumbs Up

Interestingly you don't have to declare motorcycle claims for car insurance (Admiral at least) but not the other way around. I got nailed for a total loss car claim (no fault) which came up on the data base after I made a motorcycle claim. As for NCB it's pretty hopless. The guiding principle has to be 'what's the worst outcome for me and the best for them?'
I can understand their stance as to be honest, everyone has been ripping off the insurers whenever they can for at least the last decade when no win no fee came in. They are just giving some back and who can bame them.

I had exactly the same thing, but it was with a non-fault accident.

@ peterthepillock, i never told my car insurance about my non-fault claim, and they - Bradford & Bingley (cunts) upped my premium by £500, which i then promptly cancelled, and they then charged me a £500 cancellation fee.

Needless to say i'm a lot more careful now when it comes to car insurance...

never had a problem with bike insurance thankfully.

One has to ask; are you both thick?

EVERY insurance site or telephone conversation currently says 'have you had any claims in the last 5 years' and such.. which part of "any" do you think only applies to bike or car respectively?

"any" means ANY, doesn't matter what with, as long as YOU have to declare it. Which you do...

Urgh. Go back to their web site, start a new quote, and read (and take copies of) exactly what it says regarding claims, accidents or losses, including on any pop-ups.

Then if there's any wiggle room, get on to their complaints department, state that the contract is based on their choice of wording, that their ambiguity shall be decided in your favour (it's their job to get this right) and that you look forward to having the Financial Ombudsman Service explain this to them.
