I passed my test in january 2009 and got pulled by the police in november 2010 for being a tool (yes, ive learnt my lesson 5times over) - I had to attend court in june of 2011 and got given 6points for due care and attention. They didnt say anything at court about having my licence revoked, they just said do I realise a further 6points will result in a ban. Didnt realise I had to send my licence off to receive points and a few months down the line I get a letter saying im revoked and shouldnt be driving. Am I right in thinking I still have my licence because at the time of conviction I had been driving for over 2 years? Maybe im just revoked because I didnt send my licence off to the dvla and there was abit of confusion? Have seen a few other people on the internet in the same boat as me and they still have there licences, just looking for abit of help as the dvla offices arent open until the 3rd. Thankyou

Hi

Most points apply from the date of the offense rather than the date of conviction, so on these you would be stuffed.

Think driving without due care is one where the points apply from the date of the offence.

I'm afraid it's from the date of offence rather than conviction.

I'm rather confused about how they let you keep hold of your license. I got a 6 month ban in feb 2010, i had to hand my license to the usher before i went into the court room and never saw it again until 6 months later. Surely if you had had your license revoked, then they would of kept hold of it.

Might be worth sending a (recorded) letter to the DVLA asking why your license has been revoked.

This is a revocation rather than a ban, as you've been returned to provisional status after getting 6 points within your 2 year probationary period.

Rather than take your licence immediately at court, the DVLA will generally contact you giving a date after which you lose your entitlements.

The slightly better news is, because you're not banned, you can immediately reapply and take your test, and once you pass it, you're back on the road.

The points stay on for a number of years and depends on what it was, i have a clean license in febuary thanks fuck.

Police - Points stay on your licence from date of conviction.

Thats one of the ways i got screwed.

Not entirely true, unless ive missed something.

The OP, like me, has to start from scratch again.
Apply for prov, CBT, Theory, Full bike test.

When the op does apply for a prov licence, within the 4yrs of offence, the points will still be on there.

I went to court with 3pts on my licence, explained why i shouldnt get screwed, they said we will not ban you but you must take the points. They let me walk out with my licence.
a couple of weeks later i get a letter from the DVLA saying my licence has been revoked.

As far as i'm aware, the DVLA can't endorse your license with a penalty, surely they'd pass it onto the police/CPS if you had commited an offence and then decide whether to prosecute you or not.

In my case, the courts applied the points and notified the dvla.

Yes, you're right, my post was simplified a bit.

The OP has to start again, but can reapply immediately rather than wait for a ban period to elapse.

So even though I had been driving for over 2 years by the time I attended court and received my points, im still revoked? Innocent until proven guilty and all that.. The judge did not tell me I would be revoked but he made a point of informing my friend who was also in court and receiving points that he would be. Is it not a case of im revoked because I failed to send my licence off to receive the points within the 2 weeks? Im sure i've read situations on the net the same as me and they have come out with there licences Thinking


EDIT: The 6 points for due care and attention were given for having a tyre under the legal limit (.1 something under, went to tyre garage that week and explained I thought they were low but didnt have the cash until 2 weeks time and they advised me it had another 100miles left at least!) and showing red SIDELIGHT bulbs to the front (when sidelights were on say in a car park they were clearly red, but when driving along with full lights on a main road you could see no red at all, and also for performing one handbrake turn in a empty car park I believed was private. + £145 fine

Hi

Yes you can have your licence revoked from a court case AFTER your 2 years are up, if the offence occured before the 2 years were up.

Whether you sent the licence off or not is irrelevant to that.

Read what people have written, the answer isn't going to change. If it helps to explain, you were (almost certainly) up before Magistrates, essentially untrained judges. Always ask the clerk of the court for the real story.
