I've put a thread in the workshop asking about remedying (sp?) the dodgy engine I was sold for my now dead ZZR250.

After posting that thread, I realised I should maybe take some sort of action? But, I don't know what I should be doing.

Said engine cost me £xxx.

Seller assured me the engine ran and kindly sent me a video of it running in the bike it came from.

Happy that the engine ran, I bought it from him.

The engine does NOT run, and there is a tappet just flying around in the cylinder head that's evidently cracked a casting somewhere, too.

What do I do? Do I have not a leg to stand on, since I bought this with no warranty implied or given?

OR am I right to ask for some sort of resolution, since he made it clear that the engine DOES run?

Confused, and angry about having launched a sh*t ton of money (for me) on an engine that doesn't brum!

Just recapped over the ebay ad and the engine was described as being "in good used condition" ready to fit, etc.

am I right in emailing the seller expressing my dissatisfaction? and then opening a case on paypal?

I've never had to do this before, any help would be greatly appreciated, even down to the wording I should use on the email.

I didn't collect it, it was delivered to my office via NightFreight and was with me the next day after he dispatched it.

I did indeed pay by PayPal.

Open a case with Paypal on the matter. They tend to favour the buyer in most cases. Just open a dispute - item not as described, put the messages from the seller (assuming they were from your ebay messages) and the description of the item in the box and say you want a full refund. Though you will likely not be refunded the cost of returning of the engine.

I've emailed the seller now outlining the faults with the motor, and have opened a case with PayPal, too.

I feel not far off 300 quid is too much to 'let slide'.

I wouldn't contact him at all outside of the dispute resolution process.

Just keep it factual, explain the faults and provide a price to make it in "good used condition", or alternatively ask for a full refund. Provide, or offer to provide, photos or video of it in the condition that you received it.

All that his video shows is that at one point he (or someone he knows, or some random person on the intartubes) had a similar engine in working condition. Shagging itself after the video was taken would be a good reason for him to sell it on.

The most effective scammers always come across as being good guys, it's pretty much their job.

I struggle to understand why you didn't just ask him first? Not everyone is out to con people. I'm usually more than happy to give refunds without all the hassle of a paypal dispute as long as its a genuine problem but I would be as awkward as possible if a buyer raised a dispute without actually bothering to email me. Yes you will get your money back but if the seller wants he can drag the dispute out for a fair amount of time, two months seems feasible.

How about pointing us to the listing?

EDIT:
I suspect it may be this one?

100% feedback on over 2000 sales and a top rated seller. A straight forward, "this engine is broken" email would have been easier.

Not as described should get you a Paypal refund - if he has any funds in Paypal or his bank account to cover it.

He can hardly say it wasn't obvious with the external signs on the rocker cover and if the adjuster has been floating about in there getting pounded there's a good chance some of the other parts are damaged too.

So when you have a problem with something that you buy from farmfoods would you run in waving a knife and shouting?

If you followed the story and read the original post you might have noticed that the rocker cover was cracked, I suspect the damage was more likely down to the courier.

See there you go again. None, but there are a surprising number of dicks on ebay that try it on. I sold a compressor and spray gun a few months ago to some Northern fellow who waited two weeks before complaining that it didn't work. Three times I told him to send it back. Eventually he returned it using express post at a ridiculous cost. I had great pleasure in linking him to the video of me using the equipment to spray the box he sent it in, and reminding him that postage was non refundable on items that were sold as described. It's not as described, but then £240 for a motor is cheap anyway. I'd be tempted to try and find the bits needed to fix it. If you do get your money back you'd be lucky to find another engine for the cost of that engine plus the cost of fixing it.
Surely you can swap some parts over from your previous engine and make a runner from the two?

As said, pics would help.

I think it's only polite to attempt to sort it out with the seller first before opening a dispute, particularly as they often incriminate themselves.

I think pay pal is waited in favour of the buyer anyway so as long as your return it and supply a tracking number, you should have no problems. This of course means you are out of pocket for the delivery, but you cant always have everything. Thats the way I did it. For all I know its possible to get a refund without returning it.

You will definitely get a refund though.
