Hey,

My bike was towed away this afternoon.,I don't know why, the police are trying to find out why.

The question I have is can they tow away my bike for not *displaying* a tax disc?

Only thing I can think of fit it being taken...

Taxed on system,.but not on the bike

"Failure to display" is a different and lesser offence than having an untaxed vehicle on the highway. I'm not sure the former warrants a tow (which is presumably a lift, plonk and drive rather than a literal tow).

In these days of tax records etc being available online it'd have to be a very picky twunt who towed your vehicle but traffic wardens (who do check tax discs) work to targets and are therefore very picky twunts.

Personally I'd have been on the phone to the rozzers reporting it stolen, not towed, because it's theft really. Depending on my mood I might also be claiming that the bike had had tax on it when I left the house so someone must have removed it - of course that could be a random theif or a very dishonest traffic warden.

they can tow and crush Sad for not displaying !

reality is it will just be towed .. and then only crushed if you dont pay the fee's / duty etc.

Do here is this for a story...

Spoke to the police, they said they would call me back and let me know what's going on once they found out...

Called me back just now...they PICKED UP THE WRONG BIKE.

They are returning the bike now. Seriously, they said on the phone that they was told "that there was a lot of bikes".

There is an Africa twin, a 50cc moped and my cg125...

Vehicle Excise and Registration Act 1994 wrote:
(1)The Secretary of State may make regulations under this Schedule with respect to any case where an authorised person has reason to believe that, on or after such date as may be prescribed, an offence under section 29(1) is being committed as regards a vehicle which is stationary on a public road.

(2)The regulations may provide that the authorised person or a person acting under his direction may—

(a)fix an immobilisation device to the vehicle while it remains in the place where it is stationary, or

(b)move it from that place to another place on the same or another public road and fix an immobilisation device to it in that other place.


There is some other legislation in the The Road Vehicles (Registration and Licensing) Regulations 2002 I think but I can't remember it off hand neither can I be bothered to find it.

The Police and local authorities (such as councils I believe) can tow your vehicle if it doesn't have tax displayed, regardless of whether or not your vehicle is taxed as far as I know. It will only get crushed if you don't pay the tax afterwards + the fine I guess. I figured it'd be in the VED act as I don't think S.165A covers seizing a vehicle without VED, only lack of insurance and licence.

As for what's happened to you, just make sure it gets returned. Press charges if you want, but I can't get you getting anywhere with it and doing anything but wasting your time.

Well this is just ridiculous really.

If they weren't sure which bike to pick up, why didn't they get on the phone to their boss or whoever and ask? Maybe the Africa Twin looked too heavy Thinking

Nice to hear its coming back to you tough. Just make sure you check it for any damage as soon as you get it. I'm sure they didn't take as much care as any of us would with our own bikes.

No they didn't. Theft is defined as 'taking with the intention to permanently deprive'. They didn't do that.

Didn't think they would tow it just for not displaying tax?


Came back from a lesson a few years ago, bike was taxed but I forgot to add the tax disc and there was a long print out on it giving me loads of things to check. As in, there was something wrong, but they didn't want to tell me what. Rolling Eyes

Are you talking about a private prosecution, or just having a moan in Plod's ear? I absolutely guarantee that your complaint will go straight in the Round File.

At most, you've got a civil case if you can show any loss or damages. It'd certainly be worth asking whomever towed it for some token compensation.

well at least get some compensation by perhaps saying it caused you losses by having no mode of transport.

I haven't displayed tax on my bikes for years, always been taxed, but never towed.

In fact I was displaying an old tax disc on my current bike for nearly a year, while having the current one sat at home in a draw.

They took the bike for no reason or fault of mine...

They picked up the wrong bike, they also replaced it after a few hours - no charge.

I did end up spending a couple of quid on the bus that night, but tI can't really be bothered to chase them up over the 'hassle' they put me through.

You get the first 5 days of the month you taxed your vehicle as a grace period now if you do it online. The official line is below.


Lifted from Direct.gov

If you use the electronic vehicle licensing service or tax by post at the end of the month, there’s now an exemption for not displaying a tax disc. This exemption covers the first five working days of the month to allow time for the new disc to arrive in the post. While you are still waiting for your tax disc you will need to display your current tax disc. The exemption only applies if applications are made before the current tax disc or SORN expires.
