My old SV got written off as a Cat B - so not able to be put back on the road, and turns out the only damage there was a cracked front wheel and bent forks. Even the fairing got away with no damage, just a scuff on the headlight and that's it, but yeah, cat B.
I'd say it could be a B or C, depends on the insurance company, they won't actually test it properly, they'll look at it and go 'yeah that's f*cked', I'd be suprised if they actually jig or laser the frame and do it proper proper like, they'll more than likely do an 'educated guess' from the visible damage and the repair costs, speed of the crash blah blah blah

If it's A or B they'll probably take the bike and you won't see it again.
You could just change the forks and wheel if it's bent and then ride the bike if it's a C or D and they offer you the salvage. You don't need to do anything but make it roadworthy. ____________________ a.k.a 'Geri'

Bit of information here. This suggests you need to re-register (and thus re-MoT) a cat C bike, but no need for a VIC (which cars do need).
Do not forget also that the insurer is under no obligation to sell you the wreckage back - after they have settled the claim and given you some money, it is their bike. They may offer to sell you the bike as part of the settlement, but it is not a right you have. ____________________

When it was stolen 2 days before MOT was booked, after I finished rectifying the problems, they would only have paid out the scrap value on it as it wasn't deemed roadworthy. |
That might be a stipulation by that particular insurance company, but it's a pointless one since an MOT doesn't mean a bike is roadworthy and a claim doesn't invalidate a current MOT. Seems silly that they should require it. |
I checked this with DVLA about a year ago, as the 'donor' bike I got with one of the Super-Dreams, I was told was a Cat-C.
It DID take alot of digging & I cant find the .gov web-page on it any more; all I can find is procedure for cars.
BUT: if the bike is FORMALLY recorded as a Cat-C with DVLA...
This is the first point; Cat-C is now often common 'slang' for 'written off' by the insurance Co...... doesn't necesserily mean it HAS actualkly been formally declared by them to DVLA
If DVLA get formally notofied that the bike is Cat-C'd, they set the flag on teh DVLA Data-base, and it remains CAT-C'd until that is 'cleared' by the bike passing a new MOT.
There are a LOAD of caveots & loops & potential pitfalls; and main one is over whether the Insuance Co 'declare' cat-C in abscence of teh V5.
As I can best understand it; for a formal Cat-C; Insurance co offer a settlement; and on accepting that settlement you return the V5 to the insurers who take title to the 'bike', and notify DVLA of teh write off & cat.
DVLC set the flag, and the insurers sell teh salvage.
Salvage co will NOT get a V5 with the bike; that I believe ought to go back to DVLA
To return the bike to road, you have to get an MOT to 'clear' the DVLA Cat-Flag; THEN they will issue a new V5 on application
BUT: if you take a settlement with an insurance co, where-by you retain 'salvage' as part of the settlement; you then have a quandry as to whether its formally declared or not. V5 ought to go back to DVLA but I believe they can record the cat without surrendering the V5.
If they dont declare to DVLA then you could be 'clear'... you have simply taken a settlement for damage & up to you to do what you will with it & make sure its legal & road-worthy.
If they DO declare the Cat in the abscence of V5; then you could have a full suite of effectively 'void' documents on the bike; having been nullified by the vehicle having been suspended by the cat-flag on DVLA data-base.
So, heed should be for the sake of £30... if you take settlement & salvage; get it fixed & get it tested.
BUT, beware DVLA 'Lag'.... if you are a bit swift.... and get the bike fixed & MOT'd next day after the Insurance cheque has cleared, possible that the delay in the insurance processing the claim papers, and DVLA taking any action on any Cat-Note, COULD see them effectively 'cancel' the post-crash MOT, becouse the Cat flag got set AFTER the post crash MOT was done! ____________________ My Webby'Tef's-tQ, loads of stuff about my bikes, my Land-Rovers, and the stuff I do with them!
