Bike breakdown soon after purchase from dealership - advice?

Was out for a spin on saturday (who wasn't Wink ) and my bike started to sputter around 65, throttle was off and on, bike rocking, then the engine cut out altogether. Managed to get the bike going again, got a mile or so, same thing. This carried on until the distance between cut outs was about 50m at which point i managed to get the thing off the A road and onto a petrol station forecourt.

My knowledge of bike workings is minimal, but I checked what I could (fuel hose wasn't blocked, breather tube not blocked, oil level ok) before throwing in the towel and joining the RAC (£57 expense). The RAC guy arrives and checks the petrol pump, fuel lines, a few electrical bits with a multimeter, but can't figure it out, so the bike is towed home (£111 expense).

I bought the bike from Millennium Motorcycles on the 17th Feb with the claim that they had serviced the bike before it was delivered as per their policy (they hadn't, the tires were dangerously under inflated and the chain looked like someone had smeared valve grinding paste all over it). The bike is WAY overdue a service, being 3 years old but only having one service after 300 miles, so I imagine the next service will cost a fair bit.

So I'm going to ring them today with a few choice words, but is there any chance I could wangle reimbursement out of them for the costs? Will they service the bike at all (there's no mention of a warranty anywhere on the docs or website)? Just pissed off really, spent 7 hours in total on a petrol forecourt watching bikes blasting by Thumbs Down

First of all, what bike?

Second of all, if you purchase a vehicle from a trader, the onus is on them to prove that any defects that arise within six months were not present at the time of sale. In practice this means that you're at an advantage as proof of this is very difficult.

Normally dealers give there own 3 month warranty to second hand bikes, go back there or ring them up saying they sold you a dodgy bike and try to get them to repair it and cover the costs.

not sure if you can get trading standers involved as i no nothing about what they deal with.

Warranty wasn't mentioned, and with it being my first bike I assumed stupidly it would come with one anyway from a dealership.

I was hoping I could use Trading Standards as a subtle threat when I ring them, but like you I don't actually know if they would get involved?

Don't do that yet.

Tell them what has happened, be factual and give them an opportunity to fix it.

If they play you up, or try to say it was your fault THAT is when you lay down the law and perhaps mention trading standards.

All your symptoms suggest contaminated fuel to me Confused

If you weren't happy with the bike when they delivered it re the tyres, chain etc you should have refused it then. How many miles had you done since buying it before it cut out and you had to be recovered?

RAC guy seemed to come to that conclusion too, that or injector problem, but I was half way through a full tank of fuel at the time, would it still be possibly contamination? May seem like a stupid question, but how do you end up with contaminated fuel?

Bike had 1042 miles on clock when bought, I've done 393 since. I only checked the tires and chain etc before a short ride out later, after delivery unfortunately, so I figured I'd just sort them out and save the hassle.

Trading Standards (or whatever they are calling themselves this week) are simply an information provider. They can inform you of your rights as a consumer and they can also inform the dealership of their obligations to you. Do not be under any illusions that they will go around to the dealers and sort them out for you. They will simply inform you of your rights and suggest that you consult a solicitor.

Ah... the place that offered me £400 part-ex for my bike providing I carried out some minor work to it.

I sold the bike for £1500 a week later.

Well they've agreed to fix it under warranty (as they should), but I'd have to get the bike there.

Slightly tricky as the place is 25 miles away and I don't drive Rolling Eyes

Had to pay £50 for delivery, and the van "is for sales purposes only". Did say he could collect if the van was in my area but 25 miles away is a bit out of the way.

I brimmed it last week and was half way through the tank when it happened, does diesel sit on top of petrol? If so I very may well have, although I'd adamantly deny it Rolling Eyes

You can deny it, but when they drain the tank and find diesel you'll be fuxord.

drain the tank and stuff then stick some shell v-power in there.

Sounds like it could be the CBF's infamous dodgy fuel pump issue. It's a known fault and only tends to occur on warm days. The bike will "kangaroo" but will be fine when it cools down (usually).

Have you tried riding it since?

Nah didn't mean I'd deny it in the workshop, I just meant in general Razz

Any easy way to test yourself for diesel/contaminated petrol? Going to drain the tank tonight and chuck in some V power to see if it runs steady.

It was a very warm day, and the engine itself was pretty damn hot (max speed on a 125 so revving high) when it happened. But problem persists even after being stood for 4 hours and a breezy 25 mile tow home.

Maybe fuel pump damage as a result of prolonged high temp?
