I think I got done by a scamera van up the peaks on 1st April. How long will I have to sweat it, bearing in mind easter bank holiday. Can I relax on saturday if nothing has come through?

Yours, a worried PB

Will you have to take the bank holidays into account?

No expert but IIRC it must be sent so as in the normal course of events it will arrive within 14 days
There is no post on bank holidays so I'd expect them to take that in to consideration and post it a day earlier

Pepipoo.com for this really

I've read a bit on it and never saw anywhere that it must be 14 working days and to all intents and purpose it doesn't have to arrive within 14 days just that it should have been processed and sent to arrive within that time.

I.e The nip was sent after 12 days but didn't arrive until the 16th day it will still stand as valid.

Maybe it was just some wits who'd marked their van up with camera signs for a lark?

Sorry, you're not safe yet, although I would have expected you to have received it by now.

You said you were caught on the 1st of April, so, the date whereby if you have received nothing you may be in the clear is:

19th/20th of April.

If you have not received anything by then, that is past the fourteen days. However, as far as I know it just has to be postmarked before the 14 working day deadline, if it gets to you on the 26th of April but is postmarked the 16th of April then I believe it still 'counts' for lack of a better term.

Cheers!

Paulington. I did warn you I would constantly make you look like a fool when you comment concerning things you know nothing about.

PB I believe you need to look at Section1 of the Road Traffic Offenders act 1988

This has been taken to mean that the NIP must be issued so as in the normal course of events it would be served within 14 days. There is absolutely no mention of working days in either the statute or case law merely that it must be sent to arrive within 14 days. So if sent on the 13th day as 1st class mail takes 1-2 days to arrive if it arrived late it would be time barred as in the normal course of events it could be expected to arrive late whereas if it was posted on the 12th day it would be assumed to be fine unless the 12th day was a Friday of course.

Concerning your comments about Easter bank holidays the scammerata have to take these into consideration as these are 'normal' events at this time of year, they don't get an extension for bank holidays. There is case law about this concerning post times at Christmas but as Christmas is normal for the end of December every year no extra time is granted.

HTH Thumbs Up

I think they just have to post it out within 14 days, so it could come in the middle of May, if your post is anything like it is here in Salford, the posties just come round when they feel like!

How fast were you doing?

You get some leeway y'know.

And without meaning to cause any worry to the op the original nip doesn't even have to actually arrive at all, I tried this myself on the defence that I hadn't received the first nip and just the reminder (there's a post on Pepipoo about it), as long as there's proof of it being processed and sent then it will still stand as served in time. Without reading up on sickpups dvla case I imagine it's the same with the roles reversed.

Sort of yes BUT I have yet to see a scamera partnership that could prove that they had posted a NIP once it was refuted or even paid for the postage it.

There is also the worry about the DVLA dreadful record keeping, if your vehicles details have been jumbled all your speeding or parking summonses may have been sent off to the wrong address!

This is very common indeed

https://www.bbc.co.uk/blogs/watchdog/2010/05/dvla_in_the_dock.html

Just read some of the horror stories in the thread.

Maybe but I wasn't willing enough to test it and admitted the speeding rather than the s172 (and 6 points) as I was summoneds for both and I had been speeding in the first place.

If that wasnt as old as the internet, you might catch somebody out.

Its funny seeing what it comes up with though, a car that hasnt moved, hasnt even got a engine in it for 4months, caught doing 35mph 8 days ago, and a 125 that was apparently doing 84, I wish my 125 was that fast.

Ha apparently my old MZ 125 was clocked at 74mph in Slough! Don't think I ever saw that speed in the 80,000 odd miles I rode on it!

I got done for this, NIP never showed, next thing I knew I had a court date. They had already decided before I got in the courtroom that I was being found guilty IMHO, the barrister had said something telling to me a little while earlier which showed his hand.

Twats. And it cost me a fortune. I paid the fucking barrister to sort it out as there was no way they could prove they posted anything to me, when they presented me the case file they even had a fixed camera photo of a black honda car - not the green kawasaki bike that was caught by a laser...
