Basically I cancelled a motorbike policy with MCE in march and everything was done and went smothly. Paid the cancellation fee and also sent off the declaration to say the policy is ok to cancel. Nothing happens during April so I presumed all is okay. Just checked my online banking and a Direct debit to MCE insurance has gone out so I phoned them asking whats going on and they said the policy is still live?

What?....Told them I send off the declaration and all that bollox and he said they didn't receive it so somewhere along the way its got lost and I've just paid £74 to insure my bike thats already insured with a different company?

He said they can't refund my £74 as it's in the small print that the policy will only be cancelled upon receiving the declaration so it's my fault.

What the fuck man... :S

I think the only way you can prove your case is if you sent it recorded, otherwise there is no proof that they received it. Personally I would threaten them with the ombudsmen a yu can prove that you insured it elsewhere, so try the "why would I have 2 policies arguement".

If you paid the cancellation fee then that should have been notice , why do they want a "declaration" as well?? If you get no joy by speaking to a supervisor/manager I'd go to the Financial Ombudsman.

Not insurance related but Orange did this with my mrs phone, she cancelled the contract with them and paid it off, foolishly didnt cancel the Direct Debit online and they carried on taking the money, you gotta keep on top of these people Twisted Evil

This is simple, contact the bank and demand the money is returned IMMEDIATELY to your account via the direct debit guarantee.
Tell the insurance company you posted the paperwork and as such it is deemed delivered by law (intepretation act) and you are not responsible for them losing mail, sort it out RIGHT NOW as your next communication is the insurance ombudsman to register your complaint.

Interpretation Act says that 'delivery' covers simple posting, if it was posted it was delivered as far as the act is concerned. And insurance is governed by the Road Something Something Act. So I think that you stand in a position to reclaim the money from MCE. And I think you should talk to someone who hasn't been drinking cos its his last day of term. Thumbs Up

Okay managed to phone the bank who retracted the payment earlier as the payment only went out today so had not yet been delivered. I can't prove i sent it as it was the free return post sh*t that they send with the letter. They wanted the declaration just for safety it was some random person cancelling the policy :S Although why some random person would pay a £30 cancellation fee is beyond me.

Will be phoning them in the morning to tell them they will be receiving no payment of any sort.

You don't need to prove anything. They have to prove you didn't, not easy to do lol.

FYI direct debit guarrantee doesn't specdify the payment can't have been delivered, can claim it weeks later if thats when you notice/can be bothered
