leaving my opticians last night, after trying some contact lenses, and i pulled away, cleanly and safely. there was a line of traffic the other way and some cars do skip it about 20 metres to go to the next main junction. this involves going on the other side of the road. i happened to be there, and she was just paying attention to traffic on her left jumping out. no looking for oncoming traffic of course Evil or Very Mad
bang! she his me at 7mph, knocking the bike down. Crying or Very sad scratched mirror.clutch and bar-end. i was a little annoyed, but it was funny seeing her shaking when she handed me her details Smile
i'm alright, and damage is minor, so what i should i do? any help much appreciated!! Laughing

You need to decide whether the damage is worth claiming for.

Might be worth getting a quote and asking her if she wants to pay for it rather than going through her insurance and losing NCB.

Sounds like the other drive should not be in charge of a car! Claim, of course, in the hope it makes the lesson stick for the other driver!

You'd claim on insurance for scratches to a mirror, bar end and clutch lever? Confused I'd get her to pay for them cash in hand if they really need replacing. Get new ones to stick on it when you sell it, and carry on with the cosmetically challenged ones.

You wont lose NCB if you claim against her insurance, only if someone makes a claim against you. So you might as well get it fixed through her insurance and push her premiums up for driving like a tit Thumbs Up

Its not just her premium though, is it? We all pay for claims, not just those who are claimed against.

I agree with Dainese - give her the opportunity to pay before going through the insurance.

Give her the option of paying for the damage without going through her insurance. I know how she is feeling. Yes it was her mistake but people do make mistakes. Do the decent thing and get a reasonable quote for the damage and see if she wants to settle it privately. Luckily noone was hurt and I'm glad you're ok.

Earlier this year I had a car crash and the guy I crashed into was a git and to cut a long story short, he forced me to go through my insurance company for what was about £20 worth of damage to his car (and £500 to mine)....and he got £800 out of my insurance company.

I'm still really pissed off about it. I asked him if he'd consider settling it privately, but he wasn't having it.

So now my insurance is sky high, he got £800 cash because I knocked the bumper off his E reg Vauxhall Carlton, everyone's premium is higher due to the claim, and I lost 3 years no claims.

What a heartless bastard karen!

If someone proves to me they've got insurance i'd happily settle it without claiming so long as what they're offering covers the cost of fixing it. Don't see the point in going through all the insurance hassle and as somebody else said, we all make mistakes at one point.

Could always get some people to pay his car a visit Razz.


If you claim off someone else's insurnace you still have to tell the insurance company when you are getting a quote. I believe it can effect your premium. Ie someone that has say had ten accidents that weren't considered their fault in a year they are definitely going to be a bit suspicious off.

Car drivers do tend to drive around in their metal bubbles thinking that nothing outside of it will affect them, but a bike rider in a car seems to be a lot more concious of whats going on around them. Maybe they should add some sort of encouragement or incentive so that people have some expireience or time riding a motorbike or ped before they get a car.
I would say if the lady was remorseful and nice, then give her the option of paying it herself rather than going through the insurance company. But if you were injured then go through the insurance company.
Hope you are ok, and your bikes not too messed up.

One of the reasons I suggested offering her the chance of paying rather than using the insurance is the hassle. I recently made a third party claim and it took just over nine months of agonising, phone calls and threats of court action. I didn't have the option of not using the insurance company though as my bike was a write off.

You still have to declare the accident to your insurance company even though it wasn't your fault too.

Some plainly-not-paying-attention twat ran into the side of our old car and sunk in a bit of the arse end of our car. She was hysterical as she had her 5 week old in the car. You'd think she would be a bit more careful. I was very, very angry my wife was in the car nine months pregnant. Her husband phoned that evening and offered us £250, no quotes, just the cash. We got quotes anyway - not trusting the chancing git. £900! I went straignt to his insurance company for it. Don't be fobbed off, make sure you get your bike thoroughly checked over and claim accordingly. Thumbs Up

Personally I'd always try and settle it privately as that's how I'd want it if I had a small run in with someone rather than ruining my No Claims for the sake of 30 quid.

No one is saying not to get a proper quote synaptyx. Once you've got the quote (and from what he said it won't be much) ask them if they'd rather settle it privately rather than through the insurance company as most people (is they have common sense) will do. Don't just claim through their insurance on the principle of it, ask them if they want to settle the claim privately first as most people on here would prefer if you could settle an insurance claim privately if it you would have to pay for an indicator, bar end and clutch lever, it's wouldn't be more than £50 and the hike for not having any NCB would be lots more than that and then add in the fact you've got a claim. Just be reasonable with them as you'd want them to be reasonable if it was the other way around.

Hi

They cannot force you to claim from your insurance. They can put a claim in against you. Technically all the insurance company is doing is covering the risk, and someone claiming off an insurance company is really just claiming from the person they had an accident with.

Trouble is that if someone wants to be an idiot they could try taking you to court and coming up with stupid claims as to the costs.

hey everyone
spoke to the woman again, and when i said £80 pounds for parts and £25 for a proper estimate, she said immediately its to go thorugh the insurance. bit silly really i thought, considering it's a brand new mondeo she drove. bit disappointed that ididn't get money to pay for my insurance Crying or Very sad
at least the insurance will notice my cracked fairing from a previous accident..... Laughing

Bit late to say this, but I was going to comment on not compromising.

I have heard of more than a few tales of people who have offered to forego the insurance and settle it themselves, only to be given a sob story and end up paying out of their own pocket. Usually the conversation would go something like:

"It will cost me £XXX to fix my Bike/Car/Lorry/Aeroplane"
"Oh, I didnt know it was going to be that much! Ive only got £XXX in my bank, and my husband/wife/son/daughter is going into hospital next week. How about I give you <Insert amount less than asked for>"

As I said, bit late to say all this, but it serves as a warning to all those who take pity on the ones responsible because of some (probably) made up story.

Shame she doesn't realize that the cost of repairs on an "insurance job" will be far more than what you gave her the option of paying. Not to mention the loss of her NCB.

Makes me wonder whether she's going to try and argue liability.

got my estimate in the post and laughed my head off
so the woman rejected my 100 pound offer straight away on the phone a few days back.
