Redundancy advice

Just wanted some clarification as a friend of mine is being made redundant but his explanation of why he may not get any redundancy package doesn't make sense to me.

Basically job being made redundant (along with many others) and his role being absorbed and expanded into a new job description. He has been asked to apply for this new position alongside other worker(s).

Now he's said if he doesn't apply he'll be made redundant and get some money. However, if he does apply and doesn't get the job then he's not entitled to any redundancy money.

I don't understand this and can someone clarify. Hopefully in short sentences and words of few syllables.

Im not totally clued up on the subject so I wont try to explain using made up waffle.

I would tell you mate this though,

If you apply for the job they will give it to him but he will be on 3 months probation.
They will fire him within those 3months.
No need to pay him the redundancy.

He should take the money, have a month off then get a new job.

Plus the DWP are usually a lot kinder and speak to you like a human being if you've been made redundant, as opposed to anything else. Thumbs Up

I had that exact same thing done to me. My job was made redundant, yet a new job was created (basically doing the same thing) with a new fund of money was on the horizon...I was advised to apply for the job...I didn't get it because I didn't have the qualifications they were seeking from an applicant. Cheeky sods. Mad

When this happens in Corporate Professional Land, the required qualifications are usually "half the age, half the salary, half the expectations, none of the experience, will work twice the hours."

As much as it sucks, there are two outcomes:

1. He's made redundant and gets a payout.
2. He's taken on for the new job, gets fired in the probation. He then spends ages suing for unfair dismissal whilst trying to prove it was continuous employment. After all that faffing he ends up with about the same amount as if he were made redundant.

I'd take the money and run...

I've had to reapply for my own job in the past, when the company has been laying people off. The company had a history of people just "disappearing" on a Friday so when they had to make some serious cutbacks they made a point of doing it all "by the book" - which involved publishing all the available jobs and inviting us all to apply for them.

Had I chosen to not apply or not been successful I would have got my redundancy cash. I know folks who did. But getting my own job was a formality and there was no probationary period or anything. My "continuous service" is from the day I joined the company first time round.

So either your friend's employers are (1) trying to screw your friend over, (2) misinformed or (3) trying to do everything visibly above board but are bad at communicating.

He'll probably end up taking the money as no guarantee of continuous employment status and if a probationary period then management the same and they've made it clear they don't like him even though only one able to do his job!

Even if he takes the money I suspect he'll see about a constructive dismissal claim.
