I hate volvo drivers!

you may of seen the picture in the newbikers forum under filtering through traffic, of my bike under some guys volvo. any way ive got hold of my insurance company to get a claim form but was hoping to try and settle out side of insurance. I rang him just a second ago and hes a twat, he is now saying it was not his fault, and will be taking his car in to a garage later this week and then will decide Whether to settle out side or to claim against me!! what cheek! and he said he didnt see me and i shouldnt of been overtaking on the other side of the road.... but wait a second if he didn't see me how could he presume i was even on the other side, which i wasn't! so i have now got to ring him later in the week to find out whats going to happen. if it comes to it im going to fight him as much as i can but i think the best outcome that will happen is 50:50, even tho it was 98% his fault!

refuse any further direct contact with him

inform him that he must now deal directly with his insurers.
find out from your insurer if you are likely to held liable for the claim
hopefully they will want to apportion all blame on him, if so sit back and wait.

this guy sounds like he is pulling the oldest one in the book

Having looked at your other post, I would have to say it looks to me like you are mostly at fault in that accident, and the insurance company will say so too. Two main points:

1) You were effectivley overtaking at a junction which is a big no-no.

2) You were riding on chevrons which you are only allowed to do "if it is safe to do so". The insurance company will take the oppinion that is was obviously not safe to do so otherwise your bike would not have been sitting under the front of a car.

I personally would also not consider it safe to pass on chevrons at a junction because of the possibility of oncoming traffic wanting to turn right into it.

Assuming I have read the situation correctly, inform your insurance you have had a prang and wait for them to send out the claim forms. Delay filling these in 'till he had got a quote for the damage and decide if you want to pay for it yourself or if you are letting him claim off the insurance. Then fill in the form accordingly.

Of course it is difficult to judge what happened in an accident with only a limited description so my assesment could be wrong.

Your incident with the Volvo was very similar to my accident a while ago. I too was on white lines, filtering when a metro came out of a garage into me. I did not see it as my view was obscured by a large van. I believe it was declared that the other driver had shown 'undue care and attention' by crossing the road when it was not 'clear'. I also got my uninsured losses paid for.

The chevron lines were broken which I believe means technically you can ride on them. I was riding on them at the time of my crash. I suggest you speak to your insurance company PDQ and explain it from your perspective. (Play down the speed & state you saw him but continued as you saw he was looking the other way and thought he would not proceed without looking in your direction).

The key thing here though is to learn that whenever you are approaching a junction with a car waiting to join the road, always assume the car has not seen you, and adjust your position on the road accordingly, slow down, use your horn and cover the brakes!

I understand how you feel, Im In the same position at the moment.
The difference is my bike Isn't a cheap old CG (no offence ) but a pretty expensive ( im a student so It Is) ZXR400, unlike you I have smashed fairings which cost alot.

I can't offer any advice, but would agree with Kickstart.

Either way, best of luck getting it all sorted, and try and stick to your ground. Don't deal with the driver personally anymore, just keep in constant touch with your insurance company.
