PostPosted: 04:07 - 05 Oct 2012    Post subject: My brand new YBR 125 - just knocked over by a neighbour :( Reply with quote

Yesterday I was in the kitchen when I heard my Bike alarm go off. I went out soon after to find a woman (neighbour, don't know her) lifting my bike up off the ground. I asked her if she hit it and she said she had not.

Her car was half reversed out and she just suddenly decides to get out of her car and pick up someones motorbike that happens to be on the floor. She must think i'm stupid! It was on it's centre stand and she has clearly reversed into it, pushing it forward off the stand and then panicked and tried to pick it up. I didn't see any damage to start with, I managed to get it out of her that it was her 'mistake' and she told me where she lived and then drove away. I took her licence plate number.

I subsequently checked it over and discovered that the throttle is loose, doesn't spring back and who knows what else could be wrong with it?

She came back 45 mins later and I confronted her and told her of the damage and she said she didn't knock it over and wouldn't pay a penny. I phoned my insurance people and they reckoned they could repair it and get her insurance to pay. It's in their hands now and I'm really pissed off! Even filled in a self report form with the police at my insurance companies recommendation.

Really worried this wont go well for some reason Sad

Without witnesses it's going to be very difficult to prove. She could just say she was being helpful and picked it up after seeing it lying there.

If the damage isn't too bad and easily repairable, it would be unwise to go through the insurance.

I doubt they can recover their costs and with the excess and loaded premiums you would have to pay for the next 5 years, it would cost you a lot more in the long run.

You could either take it on the chin and repair it yourself or see if there was a friendly neighbour who happened to see her do it, may be worth going door to door to a few houses either side of you.

Also have a look at any damage to her car that matches your bike.

It's a real shame that people can't tell the truth, its going to be very hard to prove as you didn't get photos of any of it, such as the car half reversed out of the drive & your bike on the floor with her trying to pick it up!

Your insurance company seem really nice and they seem to be on the case of getting it sorted, you've done all you can do at moment, just wait & see what your insurance company say.

I understand how you feel buddy it's a brand new bike and its just been knocked over, don't let it get you down Thumbs Up

It's a budget 125, it's going to be dropped. Scum will out. Now that you've reported it as a loss, you'll end up paying more in increased premiums than whatever it would have cost in duct tape and cable ties.

None of that is right, but it's not new either. Next time, either shrug it off or suggest on the spot that if she didn't knock over your bike, then it won't be you that slashes her tyres. No witnesses works both ways.

She could have been telling the truth, just throwing it out there, if there's not a mark on her car and you left it on the centre stand (which is less stable than the side stand really)
Was shereen's arse nearby? That tends to repulse YBRs in my experience Laughing

Or maybe i'm putting too much faith into humanity Razz

In line with the above, is there any chance it could have gone over of it's own accord and the alarm gone off then without you realising (out of the house, loud music or something else) and then as she has tried to lift it the alarm has gone off again? Neutral

Surely the fact that she told you where she lived is evidence enough that she admitted fault? Why would she tell you that or why would you know otherwise?

Get someone who knows about bikes to check it over for you. There probably isnt much damage if thats all you noticed.
No point going through insurance, you will end up paying it all back over the next couple of years.

Exactly! She also said that I should have parked more tucked in. Then when I told her of the damage she came over to look at it. Who does that if they didn't cause it? There was a witness to her picking the bike up. He didn't see her hit it, but saw her car half out of a parking space and her trying to pick the bike up. Know he lives here somewhere. Next time I see him I'll take his details.

Please don't suggest anything so utterly pointless and ridiculous. Tut Tut

Nitromors has been made kitten-friendly by the Euro-hippies, you'll need to buy some neat dichloromethane from eBay - that'll take it straight off. Thumbs Up

Sadly true - it's paint stripper which has had the primary paint stripping ingredient removed. Does exactly the opposite of what it says on the tin.

Sadly, I had a cover on my bike at the time (a thick cover) so there won't be any paint transfer.

If it doesn't work out slash her tyres. When she gets new tyres, slash them again. Repeat the process until you feel happy.
