What I would do is send off a V62 form to get another V5.

If you have the green slip (which you should have) then it won't cost you anything.

Also the seller is likely to get a fine for not sending off the V5.

The seller cannot gain by retaining the V5 - where was it sent too?

Really you should have been given it at time of purchase then sent it in yoursef for change of details.
This makes sense as you are the best person to accurately write your address on it.
The seller can inform DVLA of the sale on a tear off slip (older versions anyway).

As above it sounds as though it is effectively 'lost' and you need a new one.

Sorn doesn't transfer with ownership, you would need to make your own declaration

You got that backwards. The seller is responsible for sending off the main bit and the buyer keeps the tear-off.

You can apply for the V5 yourself with no charge if you have the green slip. As long as you taxed it soon after buying it then the lack of sorn is not anything for you to concern yourself with. I've had several warning when taxing or sorning bikes that I've just bought but they have never been of consequence.

You're still being bullshitted (bullshat)? V62, get it done. It's for their benefit, the V5C is a liability, not an asset.

You can't SORN until you're registered as the new keeper, and you don't know that you are registered as the new keeper until you receive the V5C. I'd very much doubt that the DVLA want that little conundrum looked into, so just ignore them if they make any noises about you not SORNing it.
