The reason they are pushing the personal injury side is because in damage only claims the value of the claim has to be over £5,000 or more before they can recover their costs, whereas in a personal injury claim, £1,000 is the target figure, although contrary to what has been said, they cannot claim a success fee as fast track claims (which is what your type of claim is called) uses the portal system and is therefore fixed costs of around £800 if liability is admitted and about £1400 if it went to trial.
It is only in the what is called multi track cases which are the more serious injuries with a value of £15,000 or more (which will be £25,000 from next year) can a solicitor charge a success fee but in any case the percentage is relevant to the degree of difficulty that the case presents.
So the more simple cases would be say 10% where the very difficult cases would be a 100% success fee but this is also subject to review and it likely to be banned next year as well.
It sounds like your case is being handled on a legal expenses funding, and so they have not done a proper risk assessment which is a law society requirement, and are simply trying to increase their chances or recovering their costs even though if your case is funded by the insurers they will get paid anyway. ____________________ It is better to arrive 30 seconds late in this world, than 30 years early in the next |
