Theres your problem.

Never trust a dealer. Have you not met my friend Del boy?

https://positivebusinessdevelopment.files.wordpress.com/2011/11/delboy.jpg

When it comes to buying a bike, or indeed anything, never trust the person selling it. They will lie because they want rid of the item. Always give the bike a thorough going over yourself. If the dealer/seller looks uncomfortable with you poking around then keep looking because they may be trying to hide something.

As for the tyre. 1mm is the legal limit so he hasnt sold you a bike thats not fit for the road. You've ridden 150 miles since. I'd suggest learning from it and sucking up the cost of a new tyre yourself.

2mm is very much legal and if the tyre is in good condition I dont see how you have any come back.
I've used Lomas several times when I lived in Derby and not had a problem.

No you are being unreasonable. You have bought a used bike not a new one, hence some parts will be worn. 2mm is a perfectly legal tread depth on a bike and I'm sure that you looked at the bike and its condition before you bought it. Nothing is faulty, nothing is illegal and as far as I can see the bike shop has done nothing wrong.

Why should they give you a free tyre? Having a used tyre on a used bike is nowt to complain about, and doesnt in anyway mean that the bike isnt in overall excellent condition. Dont try and dirty the shops rep because you want a freebee......thats not on!

Any reasonable dealer will value their reputation but that doesn't mean they have to roll-over because you were unable to negotiate at the time of buying.

I think you are being both unreasonable and naive. Treat this as a lesson so that next time you buy you do YOUR part of the job better.

No dealer reputation is a pretty big thing. Trouble is that does not take into account for buyer negligence. You bought a bike, you did not check the tyres, you were happy at the time of purchase.

They forfilled their requirements as a dealer, they sold you a bike in good condition with a full years MOT. If the MOT tester deemed it safe enough then you have no comeback.

Their reputation as good comes from the hundreds of people that have used them without issue, as Fisty said. He had no issue.

You can argue the toss all you want but it was your responsibility as the buyer to iron out any issues that could have been rectified before purchase. Had you pointed out the tyres at the time they might well have offered to change them, but since they were legal they may well have told you where to go. Wink

Consumers have responsibilities too. You had the opportunity to look over the bike or you could have paid for an independant inspection. 2mm is double the legal limit so I don't see what the problem is.

It's the sort of thing you could mention when buying and use to barter but not a month after you've paid for it.

They certainly don't have any legal obligation to do anything for you.

2mm is a fair bit of tread, which probably translates to near enough a thousand miles or so. So yes, you're whining inappropriately, and expecting a free handout.

First time you've mentioned that they said that. Still doesn't change much but maybe appeal to their better nature by asking (nicely) if they'll go halves with you on a new tire.

Not "expecting" anything.
Will probably get nothing.
Read the post, was asking for an opinion.

And opinion has been given, lol that you even asked them for a refund on a legal tyre on a bike YOU collected.

I did read the post. The fact that you requested reimbursement for the tyre being part worn implies that you expect them to accede to your request. The offered opinion of myself and others on BCF is that you're being unreasonable.

Where's the ambiguity?

Comedian of the forum are you ?

Wink

As a matter of fact, he is. Laughing

He's got a point though. Your still trying to argue the point when every single reply so far has been in the "you fucked up" camp.

Think about it this way, if you think your right, go fight the power. But before you do, take into account this thread, many of the people here have bought several bikes throughout their biking life and know a good deal about what to look for and all have said you have no claim for compensation. I would trust their advice before my own when it comes to bike matters sometimes.
